  1.1                             A resolution
  1.2             memorializing the governor to declare a flood 
  1.3             emergency. 
  1.4      
  1.5      WHEREAS, the Benton County Board of Commissioners convened 
  1.6   on April 9, 2001, an emergency meeting to consider reports of 
  1.7   flooding in the area of Little Rock Lake, Little Rock channel, 
  1.8   the Mississippi River, and in other streams and waterways 
  1.9   throughout the county; and 
  1.10     WHEREAS, the Benton County Board of Commissioners had 
  1.11  received information that those waterways were in, or were about 
  1.12  to enter, an extreme flood stage; and 
  1.13     WHEREAS, the flood levels on Little Rock Lake threaten 
  1.14  residences, structures, and property adjacent to the lake; and 
  1.15     WHEREAS, some septic systems in the Little Rock Lake area 
  1.16  have been impacted by floodwaters and are leaking to the 
  1.17  surface, posing an imminent public health risk; and 
  1.18     WHEREAS, the flooding, if not contained, is likely to 
  1.19  result in substantial loss of property and will jeopardize 
  1.20  public health; and 
  1.21     WHEREAS, pursuant to Minnesota Statutes, section 12.29, the 
  1.22  Benton County Board of Commissioners declared that a state of 
  1.23  emergency exists in Benton County, and this state of emergency 
  1.24  remains in effect until rescinded by further resolution of the 
  2.1   Benton County Board of Commissioners; NOW, THEREFORE, 
  2.2      BE IT RESOLVED by the Legislature of the State of Minnesota 
  2.3   that it respectfully requests that the Governor of the State of 
  2.4   Minnesota declare that a peacetime emergency exists in Benton 
  2.5   County pursuant to Minnesota Statutes, section 12.31, 
  2.6   subdivision 2.
