  1.1                          A bill for an act 
  1.2             relating to natural resources; modifying effective 
  1.3             period of annual state park permits; amending 
  1.4             Minnesota Statutes 1998, section 85.053, subdivision 1.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 85.053, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [FORM, ISSUANCE, VALIDITY.] (a) The 
  1.9   commissioner shall prepare and provide state park permits for 
  1.10  each calendar year that state a motor vehicle may enter and use 
  1.11  state parks, state recreation areas, and state waysides over 50 
  1.12  acres in area.  State park permits must be available and placed 
  1.13  on sale by October 1 of the year preceding the calendar year 
  1.14  that the permit is valid.  
  1.15     (b) A An annual state park permit may must be affixed when 
  1.16  purchased and may be used from the time it is affixed until the 
  1.17  end of the calendar year for which it is issued for a 12-month 
  1.18  period.  State park permits in each category must be numbered 
  1.19  consecutively for each year of issue.  
  1.20     (c) State park permits shall be issued by employees of the 
  1.21  division of parks and recreation as designated by the 
  1.22  commissioner.  State park permits also may be consigned to and 
  1.23  issued by agents designated by the commissioner who are not 
  1.24  employees of the division of parks and recreation.  All proceeds 
  1.25  from the sale of permits and all unsold permits consigned to 
  2.1   agents shall be returned to the commissioner at such times as 
  2.2   the commissioner may direct, but no later than the end of the 
  2.3   calendar year for which the permits are effective.  No part of 
  2.4   the permit fee may be retained by an agent.  An additional 
  2.5   charge or fee in an amount to be determined by the commissioner, 
  2.6   but not to exceed four percent of the price of the permit, may 
  2.7   be collected and retained by an agent for handling or selling 
  2.8   the permits.
