A bill for an act
relating to utilities; providing for cost recovery for certain utility activities
concerning alternative-fuel vehicles; amending Minnesota Statutes 2016, section
216B.16, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 216B.16, is amended by adding a subdivision
to read:

new text begin Alternative-fuel vehicles. new text end

new text begin (a) Notwithstanding any provision in this section,
a public utility may propose and the commission may approve the development and
implementation of programs and tariffs designed to address the market for alternative-fuel
vehicles. In determining whether to approve a utility proposal under this subdivision, the
commission may consider the potential net economic and environmental benefits of
alternative-fuel vehicles, as well as the degree to which the proposal:

new text begin (1) allows the public utility to respond to demand for alternative-fuel vehicles;

new text begin (2) ensures customer choice in alternative-fuel vehicle charging equipment and services;

new text begin (3) improves the utilization and modernization of the electric grid;

new text begin (4) contributes to state policy objectives; and
new text end

new text begin (5) minimizes the rate impacts on nonparticipating ratepayers.

new text begin (b) The commission may approve the recovery of reasonable costs from ratepayers for
activities under this subdivision, except that a public utility is prohibited from recovering
costs approved under this subdivision from a ratepayer that is:

new text begin (1) a pipeline that transports refined petroleum products; or
new text end

new text begin (2) a refiner of petroleum products.

new text begin (c) For the purposes of this subdivision, "alternative-fuel vehicle" means a vehicle
propelled by a fuel other than gasoline, diesel fuel, or propane.
