A bill for an act
relating to local government; placing a moratorium on
annexations by order and annexations by ordinance of
areas of 60 acres or less; amending Minnesota Statutes
2004, sections 414.031, by adding a subdivision;
414.033, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 414.031, is
amended by adding a subdivision to read:

new text begin (a) No order
for annexation may be issued under this section.

new text begin (b) Paragraph (a) does not apply to (1) proposed annexation
within the metropolitan area as defined in section 473.121,
subdivision 2, or (2) proposed annexation within a job
opportunity building zone (JOBZ) designated by the commissioner
of employment and economic development under section 469.314.

new text begin (c) This subdivision is effective the day following final
enactment and expires July 31, 2006. This subdivision applies
to annexation proceedings pending or commenced on or after the
effective date of this section.

Sec. 2.

Minnesota Statutes 2004, section 414.033, is
amended by adding a subdivision to read:

new text begin (a) No municipal council may by
ordinance declare land annexed to the municipality under
subdivision 2, clause (3).

new text begin (b) This subdivision is effective the day following final
enactment and expires July 31, 2006. This subdivision applies
to annexation proceedings pending or commenced on or after the
effective date of this section.
