1.1 A bill for an act 1.2 relating to insurance; altering the premium base for 1.3 worker's compensation to exclude wages for periods of 1.4 paid leave; amending Minnesota Statutes 2002, section 1.5 79.211, subdivision 1. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 79.211, 1.8 subdivision 1, is amended to read: 1.9 Subdivision 1. [CERTAIN WAGES INCLUDED FOR RATEMAKING.] 1.10 The rating association or an insurer shall not include wages 1.11 paid for a vacation, holiday, or sick leave in the determination 1.12 of a workers' compensation insurance premium. 1.13 An insurer, including the assigned risk plan, shall not 1.14 include wages paid for work performed in an adjacent state in 1.15 the determination of a workers' compensation premium if the 1.16 employer paid a workers' compensation insurance premium to the 1.17 exclusive state fund of the adjacent state on the wages earned 1.18 in the adjacent state. 1.19Within 30 days of October 1, 1995, a licensed data service1.20organization on behalf of its members shall file an amendment to1.21its charged class premium rates to reflect the inclusion of1.22vacation, holiday, and sick leave wages in the determination of1.23premium. Within 30 days of the filing of those pure premium1.24rates each insurer shall amend its filed schedule of rates to1.25reflect the inclusion of vacation, holiday, and sick leave wages2.1in the determination of premium.2.2 Sec. 2. [EFFECTIVE DATE.] 2.3 Section 1 is effective January 1, 2005.
