  1.1                          A bill for an act 
  1.2             relating to education; changing eligibility for the 
  1.3             post-secondary enrollment options program; amending 
  1.4             Minnesota Statutes 1998, section 124D.09, subdivision 
  1.5             5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 124D.09, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [AUTHORIZATION; NOTIFICATION.] Notwithstanding 
  1.10  any other law to the contrary, an 11th or 12th grade pupil 
  1.11  enrolled in a school or an American Indian-controlled tribal 
  1.12  contract or grant school eligible for aid under section 124D.83, 
  1.13  except a foreign exchange pupil enrolled in a district under a 
  1.14  cultural exchange program, may apply to an eligible institution, 
  1.15  as defined in subdivision 3, to enroll in nonsectarian courses 
  1.16  offered by that post-secondary institution if the student has 
  1.17  passed the basic skills tests required for graduation.  If an 
  1.18  institution accepts a secondary pupil for enrollment under this 
  1.19  section, the institution shall send written notice to the pupil, 
  1.20  the pupil's school or school district, and the commissioner 
  1.21  within ten days of acceptance.  The notice must indicate the 
  1.22  course and hours of enrollment of that pupil.  If the pupil 
  1.23  enrolls in a course for post-secondary credit, the institution 
  1.24  must notify the pupil about payment in the customary manner used 
  1.25  by the institution.
