A bill for an act
relating to state government; requiring agency demand letters to licensees to
include reasons for the demand; proposing coding for new law in Minnesota
Statutes, chapter 15.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) For purposes of this section:

(1) "State agency" means an office, board, commission, authority, department, or
other agency of the executive branch of state government, and includes constitutional
offices.

(2) "Demand" means a request or order to appear or submit documents made
by a state agency to an entity or individual licensed by the state agency as part of an
administrative investigation, audit, or enforcement action relating to an occupational or
business license. Demand includes, but is not limited to, an administrative subpoena or
similar request or order for compliance by a state agency.

(b) If a state agency issues a demand, the demand must state the legal and factual basis
for the demand. This statement must include a citation to the specific law or rule that the
state agency believes the license holder may have violated, and a summary of the facts that
have led the state agency to demand that the license holder appear or submit documents.
