A bill for an act
relating to state government; proposing various changes relating to state
finance; requiring performance measures in bills proposing new or increased
appropriations; creating a state building commission; limiting authorizations for
general obligation bonds; proposing coding for new law in Minnesota Statutes,
chapters 3; 16A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin SHORT TITLE.

new text begin This act shall be known as the "State Budget and Capital Reform Act of 2007."

Sec. 2.

new text begin [3.315] APPROPRIATION BILLS; PERFORMANCE MEASURES.
new text end

new text begin (a) A bill proposing an appropriation for a new program or activity or proposing an
increase of more than five percent in the base appropriation for an existing program or
activity must include a statement of the outcomes the legislature expects to be achieved
as a result of the new or increased appropriation. To the extent practical, the legislative
statement must also describe the measures that will be used to determine the extent to
which these outcomes are achieved. In describing these measures, a bill may adopt or
modify performance measures proposed by an agency in a budget proposal submitted as
required by section 16A.10, subdivision 1c.

new text begin (b) This section does not apply to a proposed increase in an appropriation that is
based on general budget instructions issued by the governor or the commissioner of
finance to deal with increased costs due to rent, employee compensation, or inflation,
or to a proposed increase in an appropriation that is based on caseload, pupil count, or
similar factors.

Sec. 3.

new text begin [16A.6315] LIMIT ON BOND ISSUANCE.

new text begin The commissioner must not issue general obligation bonds to the extent that issuance
of the bonds would cause general fund appropriations needed to pay the debt service on
all general obligation bonds issued by the state to exceed three percent of the amount the
commissioner estimates to be the nondedicated general fund revenues for the biennium in
which the general obligation bonds are to be issued. In estimating the nondedicated general
fund revenues for each biennium beginning after July 1, 2007, the commissioner must
decrease the estimated revenues by the percentage change in the implicit price deflator for
personal consumption expenditures for the United States as published by the Bureau of
Economic Analysis of the federal Department of Commerce from the effective date of this
section, to the time the commissioner of finance estimates general fund revenues.

Sec. 4.

new text begin In authorizing issuance of bonds, to the extent practical the legislature must not
identify specific recipients of appropriations from bond proceeds, but rather must authorize
bonds for purposes expressed in general statutes establishing governmental programs, so
that the recipients will be selected through a competitive process.

Sec. 5.

new text begin The State Building Commission is created to develop and
oversee the implementation of a program to provide, maintain, and improve the buildings
required to support the functions and duties of all three branches of state government.

new text begin The State Building Commission consists of:
new text end

new text begin (1) three members appointed by and serving at the pleasure of the governor;
new text end

new text begin (2) three members appointed by and serving at the pleasure of the speaker of the
house, including at least one member of the largest minority caucus of the house of
representatives;

new text begin (3) three members appointed by and serving at the pleasure of the Subcommittee on
Committees of the Senate Rules and Administration Committee, including at least one
member of the largest minority caucus of the senate.

new text begin Duties. new text end

new text begin The State Building Commission must:
new text end

new text begin (1) hold hearings on long-range plans related to state government buildings;
new text end

new text begin (2) make recommendations to the legislature on funding needed to construct,
maintain, and improve state government buildings; not including the Minnesota State
Colleges and Universities; and
new text end

new text begin (3) oversee implementation of the construction, maintenance, and improvement of
state government buildings with money appropriated by the legislature.

new text begin Meetings. new text end

new text begin Meetings of the commission, and any subgroups must be open
to the public. For purposes of this subdivision, a meeting occurs when a quorum is
present and action is taken regarding a matter within the jurisdiction of the commission or
subgroup. For legislative members of the commission, enforcement of this subdivision is
governed by section 3.055, subdivision 2. For nonlegislative members of the commission,
enforcement of this subdivision is governed by section 13D.06, subdivisions 1 and 2.

new text begin The State Building Commission is in the
legislative branch. The Legislative Coordinating Commission must provide administrative
support services. Members appointed by the governor receive compensation and expense
reimbursement as provided in section 15.0575.

Sec. 6. new text begin APPROPRIATION.

new text begin $....... is appropriated to the Legislative Coordinating Commission from the
general fund for the biennium ending June 30, 2009, for purposes of the State Building
Commission.
