  1.1                          A bill for an act 
  1.2             relating to taxation; property tax; providing that 
  1.3             certain governing bodies must adopt resolutions to 
  1.4             increase levies; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 275. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [275.078] [AUTHORIZATION; TAX RATE INCREASE.] 
  1.8      On or before October 1, 1999, and each subsequent year, the 
  1.9   county auditor shall certify to the governing body of each home 
  1.10  rule charter or statutory city in the county and to the county 
  1.11  board, the following information for the taxing jurisdiction: 
  1.12     (1) the taxing jurisdiction's certified levy under section 
  1.13  275.08 for the previous year, taxes payable in the current year; 
  1.14     (2) the taxing jurisdiction's net tax capacity for the 
  1.15  current assessment year, for taxes payable in the following 
  1.16  year; and 
  1.17     (3) the local tax rate, obtained by dividing the amount in 
  1.18  clause (1) by the amount in clause (2), rounded to the nearest 
  1.19  hundredth percent. 
  1.20  In order to impose a tax rate for taxes payable in the following 
  1.21  year higher than the tax rate certified by the county auditor 
  1.22  under clause (3), the governing body of the city or the county 
  1.23  board must adopt a resolution, after holding a public hearing, 
  1.24  authorizing a higher tax rate and file a copy of the resolution 
  1.25  with the county auditor on or before October 20, 1999, and each 
  2.1   year thereafter.  A county auditor is prohibited from fixing a 
  2.2   tax rate under section 275.08 for that taxing jurisdiction for 
  2.3   taxes payable in the following year that is higher than the rate 
  2.4   certified under clause (3) if a resolution has not been filed.  
  2.5   For purposes of this section, "public hearing" includes, but is 
  2.6   not limited to, regularly scheduled city council hearings and 
  2.7   county board meetings.
