  1.1                          A bill for an act 
  1.2             relating to local government; allowing local 
  1.3             regulation of outdoor advertising; amending Minnesota 
  1.4             Statutes 2000, section 462.357, subdivision 1e, as 
  1.5             added. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 462.357, 
  1.8   subdivision 1e, as added by Laws 2001, chapter 174, section 1, 
  1.9   is amended to read: 
  1.10     Subd. 1e.  [NONCONFORMITIES.] Any nonconformity other than 
  1.11  outdoor advertising, including the lawful use or occupation of 
  1.12  land or premises existing at the time of the adoption of an 
  1.13  additional control under this chapter, may be continued, 
  1.14  including through repair or maintenance, but if the 
  1.15  nonconformity or occupancy is discontinued for a period of more 
  1.16  than one year, or any nonconforming use is destroyed by fire or 
  1.17  other peril to the extent of greater than 50 percent of its 
  1.18  market value, any subsequent use or occupancy of the land or 
  1.19  premises shall be a conforming use or occupancy.  A municipality 
  1.20  may by ordinance impose upon nonconformities reasonable 
  1.21  regulations to prevent and abate nuisances and to protect the 
  1.22  public health, welfare, or safety.  This subdivision does not 
  1.23  prohibit a municipality from enforcing an ordinance that applies 
  1.24  to adults-only bookstores, adults-only theaters, or similar 
  1.25  adults-only businesses, or outdoor advertising, as defined by 
  2.1   ordinance. 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective August 1, 2001.
