A bill for an act
relating to energy; modifying provision relating to carbon dioxide emissions
by utilities; amending Minnesota Statutes 2008, section 216H.03, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 216H.03, is amended by adding a
subdivision to read:

prohibitions in subdivision 3 do not apply to emissions from anthropogenic sources of
carbon dioxide in states actively engaged in private/public partnerships to develop and
