A bill for an act
proposing an amendment to the Minnesota Constitution, article XIII, by adding
a section; providing authority to the Minnesota Public Utilities Commission,
or its successor, to issue a certificate of need for the construction of a nuclear
electric generating plant.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin CONSTITUTIONAL AMENDMENT PROPOSED TO REPEAL
NUCLEAR MORATORIUM.

new text begin An amendment to the Minnesota Constitution is proposed to the people. If the
amendment is adopted, a section shall be added to article XIII, to read:

new text begin The Minnesota Public Utilities Commission, or its successor, has authority to
issue a certificate of need for the construction of a nuclear electric generating plant.

Sec. 2. new text begin SUBMISSION TO VOTERS.

new text begin The proposed amendment must be submitted to the people at the 2010 general
election. The question submitted must be:
