  1.1                          A bill for an act 
  1.2             relating to retirement; local police and paid fire 
  1.3             consolidation accounts and state correctional 
  1.4             employees retirement plan; revising the local 
  1.5             consolidation account member contribution rate; 
  1.6             eliminating certification procedure for coverage 
  1.7             expansion; amending Minnesota Statutes 1998, section 
  1.8             353A.09, subdivision 4; repealing Minnesota Statutes 
  1.9             1998, section 352.91, subdivision 4. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1998, section 353A.09, 
  1.12  subdivision 4, is amended to read: 
  1.13     Subd. 4.  [MEMBER CONTRIBUTIONS.] (a) Following the 
  1.14  effective date of consolidation, the applicable member 
  1.15  contribution rate and applicable salary rate to which the member 
  1.16  contribution rate applies for persons who were formerly members 
  1.17  of the relief association shall must be determined as follows:  
  1.18     (1) if the person has elected coverage by the public 
  1.19  employees police and fire fund benefit plan under section 
  1.20  353A.08, the applicable member contribution rate shall be that 
  1.21  rate specified in section 353.65, subdivision 2, is 7.6 percent 
  1.22  of the applicable salary, if the consolidation account has an 
  1.23  additional municipal contribution under subdivision 5 for the 
  1.24  current calendar year, or the rate specified in section 353.65, 
  1.25  subdivision 2, if the consolidation account does not have an 
  1.26  additional municipal contribution under subdivision 5 for the 
  1.27  current calendar year, and the applicable salary rate to which 
  2.1   the member contribution rate applies shall be is the actual 
  2.2   salary of the person, as defined in section 353.01, subdivision 
  2.3   10; and 
  2.4      (2) if the person has not elected coverage by the public 
  2.5   employees police and fire fund benefit plan under section 
  2.6   353A.08, the applicable member contribution rate shall be is the 
  2.7   rate specified in section 69.77, subdivision 2a, or the rate 
  2.8   specified in the applicable general law, special law, or bylaw 
  2.9   provision governing the relief association as of the date of the 
  2.10  initiation of consolidation, whichever is greater, and the 
  2.11  applicable salary rate to which the member contribution rate 
  2.12  applies shall be is the salary rate specified in the applicable 
  2.13  general law, special law, or bylaw provision governing the 
  2.14  relief association as of the date of the initiation of 
  2.15  consolidation or the actual salary of the person, including 
  2.16  overtime pay and any regularly occurring special payments but 
  2.17  excluding lump sum annual leave payments, worker's compensation 
  2.18  payments, and severance payments, whichever salary rate is 
  2.19  greater.  
  2.20     (b) The member contribution rate and applicable salary rate 
  2.21  to which the member contribution rate applies shall be is 
  2.22  effective as of the first day of the first pay period occurring 
  2.23  after the effective date of consolidation.  
  2.24     (c) The chief administrative officer of the municipal 
  2.25  police department or municipal fire department, whichever 
  2.26  applies, shall cause the member contributions required under 
  2.27  this subdivision to be deducted in the manner and subject to the 
  2.28  terms provided in section 353.27, subdivision 4.  
  2.29     Sec. 2.  [REPEALER.] 
  2.30     Minnesota Statutes 1998, section 352.91, subdivision 4, is 
  2.31  repealed. 
  2.32     Sec. 3.  [EFFECTIVE DATE.] 
  2.33     (a) Section 1 is effective on the first day of the first 
  2.34  full payroll period occurring after the date of final enactment. 
  2.35     (b) Section 2 is effective on the day following final 
  2.36  enactment.
