  1.1                          A bill for an act 
  1.2             relating to higher education; Minnesota state colleges 
  1.3             and universities; providing for acquisition of certain 
  1.4             facilities by the board of trustees; modifying source 
  1.5             of funding for certain capital improvements at St. 
  1.6             Cloud State University; amending Minnesota Statutes 
  1.7             2000, section 136F.60, subdivision 2; Laws 2000, 
  1.8             chapter 492, article 1, section 3, subdivision 19. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 136F.60, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [METHODS OF ACQUISITION.] (a) If money has been 
  1.13  appropriated to the board to acquire lands or sites for public 
  1.14  buildings or real estate, the acquisition may be by gift, 
  1.15  purchase, or condemnation proceedings.  Condemnation proceedings 
  1.16  must be under chapter 117. 
  1.17     (b) The board may accept gifts of and enter into agreements 
  1.18  to acquire facilities that the board determines to be for the 
  1.19  good and benefit of the state colleges and universities.  Except 
  1.20  as otherwise provided in this paragraph, the terms of the 
  1.21  agreements are within the board's discretion.  The board, by way 
  1.22  of agreement, may convey, or lease for a term of years not to 
  1.23  exceed 30 years, real property under the board's control.  
  1.24  Conveyances and leases may be made with or without monetary 
  1.25  consideration.  Conveyances by the board must be by quitclaim 
  1.26  deed in a form approved by the attorney general.  Land conveyed 
  1.27  by the board must revert to the state if it is no longer used to 
  2.1   provide a facility for the primary benefit of a state college or 
  2.2   university or its students.  Agreements may be made following 
  2.3   requests for proposal or by direct negotiation.  The board may 
  2.4   not use, either directly or indirectly, state appropriations or 
  2.5   the credit of the state to pay or guarantee the payment of any 
  2.6   debt for, or any costs related to, the construction of a 
  2.7   facility acquired or constructed according to this paragraph.  
  2.8   For purposes of this paragraph, "facility" includes, but is not 
  2.9   limited to, student unions, recreational centers, and other 
  2.10  facilities for student housing, athletics, parking, academic 
  2.11  instruction, and administration. 
  2.12     Sec. 2.  Laws 2000, chapter 492, article 1, section 3, 
  2.13  subdivision 19, is amended to read: 
  2.14  Subd. 19.  St. Cloud State University                          
  2.15  (a) Lawrence Hall Remodeling                          3,864,000
  2.16  To remodel the lower floors of Lawrence 
  2.17  Hall for administrative and 
  2.18  instructional space.  The cost of 
  2.19  remodeling the top floor for student 
  2.20  housing must be paid entirely with the 
  2.21  proceeds of Minnesota state college and 
  2.22  university revenue bonds funds from 
  2.23  other than state sources and is in 
  2.24  addition to this appropriation. 
  2.25  (b) The board may do predesign for the 
  2.26  renovation of Centennial Hall and 
  2.27  design for the renovation of Eastman 
  2.28  Hall and Riverview Hall using resources 
  2.29  other than this appropriation that may 
  2.30  be available to the board.
