A bill for an act
relating to higher education; providing a rebate of nonresident tuition; proposing
coding for new law in Minnesota Statutes, chapter 135A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [135A.043] NONRESIDENT TUITION REBATE.

new text begin (a) A student who does not qualify for a resident tuition rate or its equivalent at state
universities and colleges, including the University of Minnesota, is eligible for a rebate
of the difference between the nonresident tuition rate and the resident tuition rate if the
student meets all of the following requirements:

new text begin (1) high school attendance within the state for three or more years;
new text end

new text begin (2) graduation from a state high school or attainment within the state of the
equivalent of high school graduation;

new text begin (3) enrollment in and attendance at a state public institution of higher education; and
new text end

new text begin (4) ability to provide proof of citizenship.

new text begin (b) A public institution of higher education in Minnesota must provide a tuition
rebate to a student who:

new text begin (1) meets the criteria in paragraph (a);
new text end

new text begin (2) paid nonresident tuition to attend the institution; and
new text end

new text begin (3) provides the institution with proof of citizenship within five years of enrollment.

new text begin The rebate is equal to the total nonresident tuition paid by the student less the amount
of resident tuition charged to a resident student for equivalent credits during the same
academic terms.

new text begin (c) This section is in addition to any other statute, rule, or higher education
institution regulation or policy providing eligibility for a resident tuition rate or its
equivalent to a student.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective the day following final enactment
and applies to rebate of tuition for academic terms commencing on or after that date.
