A bill for an act
relating to natural resources; removing certain cap on watershed district levies;
amending Minnesota Statutes 2018, section 103D.905, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 103D.905, subdivision 3, is amended to read:


Subd. 3.

General fund.

A general fund, consisting of an ad valorem tax levy, may not
exceed 0.048 percent of estimated market valuedeleted text begin , or $250,000, whichever is lessdeleted text end . The money
in the fund deleted text begin shalldeleted text end new text begin mustnew text end be used for general administrative expenses and for the construction
or implementation and maintenance of projects of common benefit to the watershed district.
The managers may make an annual levy for the general fund as provided in section 103D.911.
In addition to the annual general levy, the managers may annually levy a tax not to exceed
0.00798 percent of estimated market value for a period not to exceed 15 consecutive years
to pay the cost attributable to the basic water management features of projects initiated by
petition of a political subdivision within the watershed district or by petition of at least 50
resident owners whose property is within the watershed district.
