  1.1                          A bill for an act 
  1.2             relating to metropolitan agricultural preserves; 
  1.3             permitting an exception to the maximum residential 
  1.4             density requirement of long-term agricultural land 
  1.5             under certain specific conditions; amending Minnesota 
  1.6             Statutes 2000, section 473H.03, by adding a 
  1.7             subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 473H.03, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 7.  [RESIDENTIAL DENSITY EXCEPTION.] Notwithstanding 
  1.12  section 473H.02, subdivision 7, long-term agricultural land, for 
  1.13  purposes of this chapter, is defined to permit a maximum 
  1.14  residential density of not more than two units per 
  1.15  quarter/quarter, if both units are owned and occupied by members 
  1.16  of the family that owns the long-term agricultural land 
  1.17  otherwise eligible for designation as, or already designated as, 
  1.18  an agricultural preserve and on which the residential units are 
  1.19  located.  Family members include a person, the person's spouse, 
  1.20  the parents of either, and the sons, daughters, brothers, and 
  1.21  sisters of the person or the person's spouse. 
  1.22     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.23     (a) Section 1 is effective the day after its final 
  1.24  enactment. 
  1.25     (b) This act applies in the counties of Anoka, Carver, 
  1.26  Dakota, Hennepin, Ramsey, Scott, and Washington.
