  1.1                          A bill for an act 
  1.2             relating to education finance; modifying the 
  1.3             alternative facilities program; amending Minnesota 
  1.4             Statutes 2000, section 123B.59, subdivision 1; 
  1.5             repealing Minnesota Statutes 2000, section 123B.59, 
  1.6             subdivision 6.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 123B.59, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [TO QUALIFY.] An independent or special (a) 
  1.11  A school district that has developed and submitted a ten-year 
  1.12  facilities plan under subdivision 2 is eligible for alternative 
  1.13  facilities aid for the portion of its school facilities that are 
  1.14  more than 40 years old.  The alternative facilities aid equals 
  1.15  the district's eligible square footage divided by the state 
  1.16  total square footage in buildings of more than 40 years of age 
  1.17  for all participating school districts times the amount 
  1.18  appropriated in subdivision 7. 
  1.19     (b) A school district qualifies to participate in the 
  1.20  alternative facilities bonding and levy program if the 
  1.21  district that has: 
  1.22     (1) more than 66 students per grade; 
  1.23     (2) over 1,850,000 square feet of space; 
  1.24     (3) average age of building space is 15 years or older; 
  1.25     (4) insufficient funds from projected health and safety 
  1.26  revenue and capital facilities revenue to meet the requirements 
  2.1   for deferred maintenance, to make accessibility improvements, or 
  2.2   to make fire, safety, or health repairs; and 
  2.3      (5) a ten-year facility plan approved by the commissioner 
  2.4   according to subdivision 2 may participate in the alternative 
  2.5   facilities program by levying the amounts necessary for 
  2.6   repayment of bonds issued under subdivision 3 or for the amounts 
  2.7   authorized in subdivision 5. 
  2.8      (c) A school district that has school facilities or 
  2.9   additions that are between 25 and 40 years of age may levy the 
  2.10  amounts necessary to make the repairs identified in their 
  2.11  ten-year plan. 
  2.12     Sec. 2.  [REPEALER.] 
  2.13     Minnesota Statutes 2000, section 123B.59, subdivision 6, is 
  2.14  repealed July 1, 2002, for revenue for fiscal years 2003 and 
  2.15  later.
