A bill for an act
relating to natural resources; directing the commissioner of natural resources
and the Environmental Quality Board to amend rules relating to scram mining
operations.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin RULEMAKING; SCRAM MINING OPERATIONS.

new text begin (a) The commissioner of natural resources shall amend Minnesota Rules, part
6130.0100, subpart 16, to add the production of natural ore agglomerates, including
heat-treated pellets made from natural ore concentrates, to the definition of "scram mining
operation."

new text begin (b) The Environmental Quality Board shall amend Minnesota Rules, part 4410.4600,
subpart 1, so that it reads:

new text begin "Projects within subparts 2; 8, item C; and 26 are exempt from parts 4410.0200 to
4410.6500. Projects within subparts 3 to 7; 8, item B; 9 to 25; and 27 are exempt from
parts 4410.0200 to 4410.6500, unless they have characteristics that meet or exceed any of
the thresholds specified in part 4410.4300 or 4410.4400."

new text begin (c) The commissioner of natural resources and the Environmental Quality Board
may use the good cause exemption under Minnesota Statutes, section 14.388, subdivision
1, clause (3), to adopt rules under this section, and Minnesota Statutes, section 14.386,
does not apply, except as provided under Minnesota Statutes, section 14.388.
