  1.1                          A bill for an act 
  1.2             relating to new sports facilities; creating a proposal 
  1.3             review and recommendation process; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 4A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PURPOSE; FINDINGS.] 
  1.7      This act establishes a process to assess proposals for 
  1.8   state involvement in new sports stadium construction and 
  1.9   facilities for youth sports and to recommend to the legislature 
  1.10  and the governor a plan for financing such construction and 
  1.11  related costs.  The legislature finds a state interest in 
  1.12  facilitating private investment in publicly owned facilities.  
  1.13  It is an appropriate goal of state policy to encourage private 
  1.14  investment with tax incentives.  Under this act, viable private 
  1.15  sector stadium proposals will be selected for potential state 
  1.16  partnerships. 
  1.17     Sec. 2.  [4A.20] [STADIUM PLANS; REVIEW AND APPROVAL.] 
  1.18     Subdivision 1.  [STADIUM REVIEW COMMISSION.] The governor 
  1.19  shall appoint nine persons to serve on a stadium review 
  1.20  commission.  One person shall be appointed from each of 
  1.21  Minnesota's eight congressional districts.  The ninth person 
  1.22  shall be the director of the strategic and long-range planning 
  1.23  office who shall serve as chair.  Members of the commission 
  1.24  shall not receive compensation for their service but may be 
  1.25  compensated for expenses by the strategic and long-range 
  2.1   planning office.  The strategic and long-range planning office 
  2.2   shall provide staff for the commission. 
  2.3      Subd. 2.  [REVIEW AND APPROVAL.] For any proposal that is 
  2.4   submitted, the commission shall review the proposal and, within 
  2.5   90 days of the commission's receipt, determine if the proposal 
  2.6   is financially viable and deliver a written report and 
  2.7   recommendation that meets all requirements of this act.  In 
  2.8   determining whether a proposal is financially viable, the 
  2.9   commission shall consider the following: 
  2.10     (1) whether the proposal includes a credible estimate of 
  2.11  total costs, including land and improvements, supported by an 
  2.12  analysis of architects or similarly qualified professionals and 
  2.13  at least $150,000,000 in privately raised funds available to 
  2.14  apply to the total costs; 
  2.15     (2) whether a substantial market exists for sporting events 
  2.16  proposed to occur at the stadium; 
  2.17     (3) whether the proposal has the active cooperation of each 
  2.18  sports organization proposed to be a principal user of the 
  2.19  proposed stadium; 
  2.20     (4) whether the proposal includes a viable finance plan 
  2.21  that identifies adequate funding sources for construction and 
  2.22  operation of the stadium; and 
  2.23     (5) whether the proposal includes a proposed site endorsed 
  2.24  by the city, county, or other jurisdiction where that proposed 
  2.25  site is located, a proposed site for which the owner has 
  2.26  indicated its intent to make the site available on terms 
  2.27  included within the estimate of total costs, or a recommendation 
  2.28  for an appropriate site selection process. 
  2.29     The commission may reject any proposal that does not meet 
  2.30  the qualifications of this subdivision.  In determining the 
  2.31  merits of a given proposal, the commission may choose whether to 
  2.32  hold public hearings. 
  2.33     Subd. 3.  [CERTIFICATION FOR FINANCIAL ASSISTANCE.] Upon 
  2.34  completion of the review under subdivision 2, the commission 
  2.35  shall state its determination of financial viability in a 
  2.36  publicly available written report to the legislature and the 
  3.1   governor.  This report shall also recommend the forms and 
  3.2   amounts of financial assistance the commission determines to be 
  3.3   necessary to complete the stadium as submitted by the proposing 
  3.4   person or organization.  The report may also comment on any 
  3.5   development aspects of the proposal. 
  3.6      The report shall include other information and 
  3.7   recommendations the commission deems necessary. 
  3.8      Sec. 3.  [EFFECTIVE DATE.] 
  3.9      Sections 1 and 2 are effective the day following final 
  3.10  enactment.
