A bill for an act
relating to single-use plastics; banning the sale, offering for sale, or provision of
single-use plastics by hotels; providing civil penalties; proposing coding for new
law in Minnesota Statutes, chapter 325E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) For purposes of this section, the terms in this subdivision
have the meanings given them.

new text begin (b) "Hotel" has the meaning given "hotel or motel" under section 157.15, subdivision
7.

new text begin (c) "Plastic" means a synthetic material composed of polymers that can be shaped when
soft and then hardened to retain a given shape.

new text begin (d) "Polymer" means a substance composed of very large molecules that are repeated
units of simpler chemicals called monomers.

new text begin (e) "Single-use" means a product designed to be used once by a consumer before disposal
or recycling, including but not limited to bottles containing liquids for human consumption,
food serviceware, and plastic bags.

new text begin After January 1, 2022, a hotel is prohibited from selling, offering
for sale, or providing to its customers a single-use plastic product.

new text begin Enforcement; civil penalty; injunctive relief. new text end

new text begin (a) The owner of a hotel that
violates subdivision 2 is subject to a civil penalty of $50 for each single-use plastic product
sold, offered for sale, or provided to the hotel's customers, up to a maximum penalty of
$10,000, and may be enjoined from the violation.

new text begin (b) The attorney general may bring an action in the name of the state in a court of
competent jurisdiction to recover civil penalties or for injunctive relief as provided in this
subdivision. The attorney general may accept an assurance of discontinuance of acts in
violation of subdivision 2 in the manner provided in section 8.31, subdivision 2b.
