  1.1                          A bill for an act 
  1.2             relating to human services; providing for changes to 
  1.3             the rate setting for deep rural facilities with low 
  1.4             operating rates; appropriating money; amending 
  1.5             Minnesota Statutes 2000, section 256B.431, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 256B.431, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 29a.  [RATE INCREASES EFFECTIVE JULY 1, 2001, FOR 
  1.11  LOW-COST DEEP RURAL FACILITIES.] Following the determination 
  1.12  under this section or any other applicable section of the 
  1.13  payment rate for the rate year beginning July 1, 2001, the case 
  1.14  mix class A operating payment rate for a nursing facility 
  1.15  classified in deep rural geographic group 1 according to 
  1.16  Minnesota Rules, part 9549.0052, subpart 2, with its June 30, 
  1.17  2001, arithmetic mean operating rate in the lowest ten percent 
  1.18  of the June 30, 2001, arithmetic mean operating rates of all 
  1.19  nursing facilities in the state shall be increased to the 
  1.20  statewide median class A operating payment rate and the payment 
  1.21  rate for all other case mix classes shall be increased to the 
  1.22  modified case mix class A rate multiplied by the class weight 
  1.23  for that case mix class established in Minnesota Rules, part 
  1.24  9549.0058, subpart 3.  The rate increases for each facility 
  1.25  under this subdivision shall be included in the facility's total 
  1.26  payment rates for the purposes of determining future rates under 
  2.1   this section or any other section. 
  2.2      Sec. 2.  [APPROPRIATION.] 
  2.3      $....... is appropriated from the general fund to the 
  2.4   commissioner of human services for the biennium beginning July 
  2.5   1, 2001, for the purposes in section 1.
