  1.2             relating to telecommunications; requiring wireless 
  1.3             telecommunications providers to offer statewide 
  1.4             service; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 237. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [237.82] [SERVICE PLAN FOR WIRELESS PROVIDERS.] 
  1.8      Subdivision 1.  [DEFINITIONS.] (a) The definitions in this 
  1.9   subdivision apply to this section. 
  1.10     (b) "Provider" means a provider of wireless 
  1.11  telecommunications services. 
  1.12     (c) "Wireless telecommunications services" means commercial 
  1.13  mobile radio services as defined in Code of Federal Regulations, 
  1.14  title 47, part 20. 
  1.15     Subd. 2.  [PLANS REQUIRED.] (a) Each provider offering 
  1.16  wireless telecommunications services in the state as of June 30, 
  1.17  2004, must offer those services in all areas of the state by 
  1.18  July 1, 2009.  Each provider must file its plan for complying 
  1.19  with this requirement with the commission by August 1, 2004. 
  1.20     (b) A provider seeking to provide wireless 
  1.21  telecommunications services in the state after June 30, 2004, 
  1.22  must offer those services in all areas of the state within five 
  1.23  years of the date the provider begins to provide services.  The 
  1.24  provider must file its compliance plan with the commission 
  1.25  before offering services in the state.
