  1.1                          A bill for an act 
  1.2             relating to environment; requiring disclosure of 
  1.3             treated wood in real estate transactions; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 82.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [82.198] [WOOD TREATED WITH ARSENIC; 
  1.7   DISCLOSURE.] 
  1.8      (a) In any jurisdiction where disclosure is required or 
  1.9   given before a transfer of ownership of residential property, 
  1.10  the use of wood treated with arsenic, inorganic arsenic, or an 
  1.11  arsenic copper combination such as chromated copper arsenate 
  1.12  wood preservative fungicide in any application on the property 
  1.13  where children may come in contact with the treated wood must be 
  1.14  disclosed. 
  1.15     (b) In any jurisdiction where inspection of residential 
  1.16  property prior to a transfer of ownership is required or 
  1.17  conducted for the benefit of a prospective buyer, the inspector 
  1.18  shall notify the prospective buyer that exposed wood, if treated 
  1.19  with arsenic, inorganic arsenic, or an arsenic copper 
  1.20  combination such as chromated copper arsenate wood preservative 
  1.21  fungicide in any application on the property where children may 
  1.22  come in contact with the wood may pose a risk to children, and 
  1.23  that the exposed wood should be sealed every two years.
