  1.1                          A bill for an act 
  1.2             relating to real property; property surrounding the 
  1.3             Coldwater Springs area in the city of Minneapolis; 
  1.4             authorizing acquisition and requiring transfer by the 
  1.5             metropolitan airports commission of the property; 
  1.6             amending Minnesota Statutes 2000, section 473.608, by 
  1.7             adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 473.608, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [COLDWATER SPRINGS PROPERTY.] (a) The 
  1.12  metropolitan airports commission may acquire property, 
  1.13  consisting of approximately 27 acres in and around Coldwater 
  1.14  Springs in the city of Minneapolis, from the secretary of the 
  1.15  interior of the United States or any other federal official or 
  1.16  agency authorized to transfer the property.  If the commission 
  1.17  acquires the property, the commission shall convey all of its 
  1.18  interest in the property, other than the interest permitted to 
  1.19  be retained under paragraph (b), to the commissioner of natural 
  1.20  resources for park, green space, or similar uses. 
  1.21     (b) To preserve its ability to conduct current or future 
  1.22  aviation operations at the Minneapolis-St. Paul International 
  1.23  Airport and to protect the commission from potential liability 
  1.24  for those aviation operations, the commission may: 
  1.25     (1) retain an easement permitting overflight or another 
  1.26  similar property interest in the property; or 
  2.1      (2) impose restrictions on the transferred property's use 
  2.2   that would be inconsistent with or may create conflicts with 
  2.3   aviation operations. 
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      Section 1 applies in the counties of Anoka, Dakota, 
  2.6   Hennepin, Ramsey, Scott, and Washington and is effective the day 
  2.7   following its final enactment.
