  1.1                          A bill for an act 
  1.2             relating to fair campaign practices; prohibiting 
  1.3             negative checkoff plans or schemes; amending Minnesota 
  1.4             Statutes 1998, section 211B.15, subdivision 16. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 211B.15, 
  1.7   subdivision 16, is amended to read: 
  1.8      Subd. 16.  [EMPLOYEE OR STUDENT POLITICAL FUND 
  1.9   SOLICITATION.] Any solicitation of political contributions by an 
  1.10  employee or student must be in writing, informational and 
  1.11  nonpartisan in nature, and not promotional for any particular 
  1.12  candidate or group of candidates.  A solicitation of political 
  1.13  contributions by an employee or student that involves the use of 
  1.14  a plan or scheme whereby the employee or student is deemed to 
  1.15  agree to a contribution by the employee's or student's inaction 
  1.16  or failure to object is prohibited.  The solicitation must 
  1.17  consist only of a general request on behalf of an independent 
  1.18  political committee (conduit fund) and must state that there is 
  1.19  no minimum contribution, that a contribution or lack thereof 
  1.20  will in no way impact the employee's employment or student's 
  1.21  academic standing, that the employee or student must direct the 
  1.22  contribution to candidates of the employee's or student's 
  1.23  choice, and that any response by the employee or student shall 
  1.24  remain confidential and shall not be directed to the 
  1.25  employee's or student's supervisors or managers.  Questions from 
  2.1   an employee or student regarding a solicitation may be answered 
  2.2   orally or in writing consistent with the above requirements.  
  2.3   Nothing in this subdivision authorizes a corporate donation of 
  2.4   an employee's time prohibited under subdivision 2. 
  2.5      For purposes of this subdivision, "student" means an 
  2.6   individual who is enrolled in and attends full time a private or 
  2.7   public post-secondary educational institution.
