  1.1                          A bill for an act 
  1.2             relating to taxation; providing an income tax credit 
  1.3             for expenditures for historic structure 
  1.4             rehabilitation; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 290. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [290.0675] [CREDIT FOR HISTORIC STRUCTURE 
  1.8   REHABILITATION.] 
  1.9      Subdivision 1.  [DEFINITIONS.] (a) As used in this section, 
  1.10  the terms defined in this subdivision have the meaning given. 
  1.11     (b) "Certified historic structure" means a property located 
  1.12  in Minnesota and listed individually on the National Register of 
  1.13  Historic Places or a historic property designated by either a 
  1.14  certified local government or a heritage preservation commission 
  1.15  created pursuant to the National Historic Preservation Act of 
  1.16  1966 and whose designation is approved by the state historic 
  1.17  preservation officer. 
  1.18     (c) "Eligible property" means a certified historic 
  1.19  structure or a structure in a certified historic district that 
  1.20  is offered or used for residential or business purposes. 
  1.21     (d) "Structure in a certified historic district" means a 
  1.22  structure located in Minnesota which is certified by the state 
  1.23  historic preservation office as contributing to the historic 
  1.24  significance of a certified historic district listed on the 
  1.25  National Register of Historic Places, or a local district that 
  2.1   has been certified by the United States Department of the 
  2.2   Interior. 
  2.3      Subd. 2.  [CREDIT ALLOWED.] A taxpayer that incurs costs 
  2.4   for the rehabilitation of eligible property may take a credit 
  2.5   against the tax imposed under this chapter in an amount equal to 
  2.6   25 percent of the total costs of rehabilitation.  Costs of 
  2.7   rehabilitation include, but are not limited to, qualified 
  2.8   rehabilitation expenditures as defined under section 47(c)(2)(A) 
  2.9   of the Internal Revenue Code, provided that the costs of 
  2.10  rehabilitation must exceed 50 percent of the total basis in the 
  2.11  property at the time the rehabilitation activity begins, and the 
  2.12  rehabilitation must meet standards consistent with the standards 
  2.13  of the Secretary of the Interior for rehabilitation as 
  2.14  determined by the state historic preservation office of the 
  2.15  Minnesota historical society. 
  2.16     Subd. 3.  [CARRYBACK AND CARRYFORWARD.] If the amount of 
  2.17  the credit under subdivision 2 exceeds the tax liability under 
  2.18  chapter 290 for the year in which the cost is incurred, the 
  2.19  amount that exceeds the tax liability may be carried back to any 
  2.20  of the three preceding taxable years or carried forward to each 
  2.21  of the ten taxable years succeeding the taxable year in which 
  2.22  the expense was incurred.  The entire amount of the credit must 
  2.23  be carried to the earliest taxable year to which the amount may 
  2.24  be carried.  The unused portion of the credit must be carried to 
  2.25  the following taxable year. 
  2.26     Subd. 4.  [PARTNERSHIPS; MULTIPLE OWNERS.] Credits granted 
  2.27  to a partnership, a limited liability company taxed as a 
  2.28  partnership, or multiple owners of property shall be passed 
  2.29  through to the partners, members, or owners, respectively, pro 
  2.30  rata or pursuant to an executed agreement among the partners, 
  2.31  members, or owners documenting an alternate distribution method. 
  2.32     Subd. 5.  [PROCESS.] To claim the credit, the taxpayer must 
  2.33  apply to the state historic preservation office of the Minnesota 
  2.34  historical society before a historic rehabilitation project 
  2.35  begins.  The state historic preservation office shall determine 
  2.36  the amount of eligible rehabilitation costs, and determine 
  3.1   whether the rehabilitation meets the standards of the United 
  3.2   States Department of the Interior.  The state historic 
  3.3   preservation office shall issue certificates verifying 
  3.4   eligibility for and the amount of credit.  The taxpayer shall 
  3.5   attach the certificate to any income tax return on which the 
  3.6   credit is claimed. 
  3.7      Subd. 6.  [MORTGAGE CERTIFICATES; CREDIT FOR LENDING 
  3.8   INSTITUTIONS.] (a) The taxpayer may elect, in lieu of the credit 
  3.9   otherwise allowed under this section, to receive a historic 
  3.10  rehabilitation mortgage credit certificate. 
  3.11     (b) For purposes of this subdivision, a historic 
  3.12  rehabilitation mortgage credit is a certificate that is issued 
  3.13  to the taxpayer in accordance with procedures prescribed by the 
  3.14  state historic preservation officer with respect to the 
  3.15  certified rehabilitation, and that meets the requirements of 
  3.16  this paragraph.  The face amount of the certificate must be 
  3.17  equal to the credit that would be allowable under subdivision 2 
  3.18  to the taxpayer with respect to the rehabilitation.  The 
  3.19  certificate may only be transferred by the taxpayer to a lending 
  3.20  institution, including a nondepository home mortgage lending 
  3.21  institution, in connection with a loan: 
  3.22     (1) that is secured by the building with respect to which 
  3.23  the credit is issued; and 
  3.24     (2) the proceeds of which may not be used for any purpose 
  3.25  other than the acquisition or rehabilitation of the building. 
  3.26     (c) In exchange for the certificate, the lending 
  3.27  institution must provide to the taxpayer an amount equal to the 
  3.28  face amount of the certificate, discounted by the amount by 
  3.29  which the federal income tax liability of the lending 
  3.30  institution is increased due to its use of the certificate in 
  3.31  the manner provided in this section.  That amount must be 
  3.32  applied, as directed by the taxpayer, in whole or part: 
  3.33     (1) to reduce the principal amount of the loan; 
  3.34     (2) to reduce the rate of interest on the loan; or 
  3.35     (3) only in the case of a qualified historic home that is 
  3.36  located in a poverty impacted area as designated by the state 
  4.1   historic preservation officer, to reduce the taxpayer's cost of 
  4.2   purchasing the building. 
  4.3      The lending institution may take as a credit against the 
  4.4   tax due under this chapter an amount equal to the amount 
  4.5   specified in the certificate.  If the amount of the discount 
  4.6   retained by the lender exceeds the amount by which the lending 
  4.7   institution's federal income tax liability is increased due to 
  4.8   the use of a mortgage credit certificate, the excess shall be 
  4.9   refunded to the borrower with interest at the rate prescribed by 
  4.10  the state historic preservation officer.  The lending 
  4.11  institution may carry forward all unused credits under this 
  4.12  subdivision until exhausted.  Nothing in this subdivision 
  4.13  requires a lending institution to accept a historic 
  4.14  rehabilitation certificate from any person. 
  4.15     Sec. 2.  [DETERMINATION OF ECONOMIC IMPACT.] 
  4.16     The Minnesota historical society shall annually determine 
  4.17  the economic impact to the state from the rehabilitation of 
  4.18  eligible property for which credits are provided under section 
  4.19  1, and report on the impact to the committees on taxes of the 
  4.20  senate and house of representatives. 
  4.21     Sec. 3.  [EFFECTIVE DATE.] 
  4.22     Section 1 is effective for taxable years beginning after 
  4.23  December 31, 1999.
