A bill for an act
relating to state lands; authorizing the sale of certain state lands bordering public
water in Carlton County.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PUBLIC SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
WATER; CARLTON COUNTY.

new text begin (a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
Carlton County may sell the tax-forfeited land described in paragraph (c) by public sale
under the remaining provisions of Minnesota Statutes, chapter 282.

new text begin (b) The conveyance must be in a form approved by the attorney general. The attorney
general may make changes to the legal description to correct errors and ensure accuracy.

new text begin (c) The lands to be sold are located in Carlton County and are described as:

new text begin (1) parcel identification number 45-058-3840;
new text end

new text begin (2) parcel identification number 72-090-4970;
new text end

new text begin (3) parcel identification number 72-090-5080;
new text end

new text begin (4) parcel identification number 72-090-5110; and
new text end

new text begin (5) parcel identification number 84-020-0410.

new text begin (d) The county has determined that the county's land management interests would be
best served if the lands were returned to private ownership.

Sec. 2. new text begin PUBLIC SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
WATER; CARLTON COUNTY.

new text begin (a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
Carlton County may sell the tax-forfeited land described in paragraph (c) by public sale
under the remaining provisions of Minnesota Statutes, chapter 282.

Before each sale, the commissioner of revenue must grant a permanent conservation easement
according to Minnesota Statutes, section 282.37. The easements must be 75 feet in width
on each side of the centerline of the designated trout stream and tributaries to provide riparian
protection, angler access, and access to adjoining conservation easements. The easement
must exclude any existing road right-of-way.
