  1.1                          A bill for an act 
  1.2             relating to crimes; prohibiting making counterfeit 
  1.3             drivers' licenses and identification cards or having 
  1.4             instruments and material for counterfeiting drivers' 
  1.5             licenses and identification cards; imposing criminal 
  1.6             penalties; proposing coding for new law in Minnesota 
  1.7             Statutes, chapter 609. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [609.652] [FRAUDULENT DRIVERS' LICENSES AND 
  1.10  IDENTIFICATION CARDS; PENALTY.] 
  1.11     Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.12  "driver's license or identification card" means a driver's 
  1.13  license or identification card issued by the driver and vehicle 
  1.14  services division of the department of public safety or its 
  1.15  authorized agents or those of any state or jurisdiction that 
  1.16  issues licenses recognized in this state for the operation of a 
  1.17  motor vehicle or that issues identification cards recognized in 
  1.18  this state for the purpose of indicating a person's true name 
  1.19  and age.  "Fraudulent driver's license or identification card" 
  1.20  means a document in similitude of and purporting to be a 
  1.21  driver's license or identification card. 
  1.22     Subd. 2.  [CRIMINAL ACTS.] A person who does any of the 
  1.23  following with intent to defraud is guilty of a crime: 
  1.24     (1) has in control, custody, or possession any plate, 
  1.25  block, press, stone, or other implement, or any part of such an 
  1.26  item, designed to assist in making a fraudulent driver's license 
  2.1   or identification card; 
  2.2      (2) engraves, makes, or amends, or begins to engrave, make, 
  2.3   or amend, any plate, block, press, stone, or other implement for 
  2.4   the purpose of producing a fraudulent driver's license or 
  2.5   identification card; 
  2.6      (3) has in control, custody, or possession or makes or 
  2.7   provides paper or other material adapted and designed for the 
  2.8   making of a fraudulent driver's license or identification card; 
  2.9      (4) has in control, custody, or possession any item 
  2.10  described in clauses (1) to (3) with intent to sell, issue, 
  2.11  publish, pass, or utter a fraudulent driver's license or 
  2.12  identification card or to cause or permit the item or the 
  2.13  fraudulent document to be used in forging or making a false or 
  2.14  counterfeit driver's license or identification card; or 
  2.15     (5) prints, photographs, or in any manner makes or executes 
  2.16  an engraved photograph, print, or impression by any process 
  2.17  whatsoever in the similitude of a driver's license or 
  2.18  identification card with the intent to sell, issue, publish, 
  2.19  pass, or utter the fraudulent driver's license or identification 
  2.20  card or to cause or permit the photograph, print, or impression 
  2.21  to be used in forging or making a fraudulent driver's license or 
  2.22  identification card. 
  2.23     Subd. 3.  [PENALTIES.] A person who does any act in 
  2.24  subdivision 2 may be sentenced to imprisonment for not more than 
  2.25  ten years or to payment of a fine of not more than $20,000, or 
  2.26  both. 
  2.27     Sec. 2.  [EFFECTIVE DATE.] 
  2.28     Section 1 is effective August 1, 2001, and applies to 
  2.29  crimes committed on or after that date.
