A bill for an act
relating to elections; specifying campaign finance reporting requirements and
limiting the carryforward allowance for certain county commissioner and city
council candidates; amending Minnesota Statutes 2006, sections 10A.01,
subdivision 10; 10A.09, subdivision 1; 10A.257, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 10A.01, subdivision 10, is amended to
read:


Subd. 10.

Candidate.

new text begin (a) new text end "Candidate" means an individual who seeks nomination
or election as a state constitutional officer, legislator, or judge. An individual is deemed
to seek nomination or election if the individual has taken the action necessary under
the law of this state to qualify for nomination or election, has received contributions or
made expenditures in excess of $100, or has given implicit or explicit consent for any
other person to receive contributions or make expenditures in excess of $100, for the
purpose of bringing about the individual's nomination or election. A candidate remains
a candidate until the candidate's principal campaign committee is dissolved as provided
in section 10A.24.

new text begin (b) For purposes of sections 10A.09, 10A.105, 10A.14 to 10A.242, and 10A.257,
"candidate" includes an individual who seeks nomination or election as a county
commissioner, if the county has a population greater than 100,000, and an individual
seeking nomination or election as a city council member, if the city has a population greater
than 100,000 according to the most recently available census data, and the individual is
not otherwise subject to the reporting requirements of chapter 383B. Sections 211A.02 to
211A.06 do not apply to individuals meeting the definition described in this paragraph.

Sec. 2.

Minnesota Statutes 2006, section 10A.09, subdivision 1, is amended to read:


Subdivision 1.

Time for filing.

Except for a candidate for elective office in the
judicial branch, an individual must file a statement of economic interest with the board:

(1) within 60 days of accepting employment as a public official deleted text begin ordeleted text end new text begin ,new text end a local official in
a metropolitan governmental unitnew text begin , a city council member in any city with a population
greater than 100,000, or a county commissioner in a county with a population greater than
100,000, if the commissioner is not subject to chapter 383B

(2) within 14 days after filing an affidavit of candidacy or petition to appear on the
ballot for an elective state office or an elective local office in a metropolitan governmental
unit;

(3) in the case of a public official requiring the advice and consent of the senate,
within 14 days after undertaking the duties of office; or

(4) in the case of members of the Minnesota Racing Commission, the director
of the Minnesota Racing Commission, chief of security, medical officer, inspector of
pari-mutuels, and stewards employed or approved by the commission or persons who
fulfill those duties under contract, within 60 days of accepting or assuming duties.

Sec. 3.

Minnesota Statutes 2006, section 10A.257, subdivision 1, is amended to read:


Subdivision 1.

Unused funds.

new text begin (a) new text end After all campaign expenditures and noncampaign
disbursements for an election cycle have been made, an amount up to 50 percent of the
election year expenditure limit for the office may be carried forward. Any remaining
amount up to the total amount of the public subsidy from the state elections campaign
fund must be returned to the state treasury for credit to the general fund under section
10A.324. Any remaining amount in excess of the total public subsidy must be contributed
to the state elections campaign fund or a political party for multicandidate expenditures as
defined in section 10A.275.

new text begin (b) Candidates for city council or county commissioner who are subject to this
chapter as described in section 10A.01, subdivision 10, paragraph (b), may carry forward
an amount not exceeding $10,000 after all campaign expenditures and noncampaign
disbursements for an election cycle are made. Any remaining amount in excess of
$10,000 must be contributed to the general revenue fund of the city or county in which the
candidate sought office.
