  1.1                          A bill for an act 
  1.2             relating to education; providing for public safety 
  1.3             revenue for school districts; proposing coding for new 
  1.4             law in Minnesota Statutes, chapter 121A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [121A.30] [PUBLIC SAFETY REVENUE FOR SCHOOL 
  1.7   DISTRICTS.] 
  1.8      Subdivision 1.  [ELIGIBILITY.] For fiscal year 2000 and 
  1.9   later, a school district which maintains an enrollment of 
  1.10  greater than 900 students in one school building is eligible for 
  1.11  public safety revenue for student and public safety and security.
  1.12     Subd. 2.  [REVENUE.] A district's public safety revenue is 
  1.13  equal to $30 times the number of resident pupil units served in 
  1.14  the school building. 
  1.15     Subd. 3.  [LEVY.] A district may levy an amount, not to 
  1.16  exceed the district's public safety revenue times the lesser of 
  1.17  one or the ratio of the adjusted net tax capacity divided by its 
  1.18  resident pupil units for that school year to $10,000.  The levy 
  1.19  authorized under this subdivision is not included in determining 
  1.20  the school district's levy limitations. 
  1.21     Subd. 4.  [AID.] A district's public safety aid is equal to 
  1.22  the difference between the district's revenue minus the levy.  
  1.23  If a district does not levy the entire amount permitted, the 
  1.24  district's aid must be reduced in proportion to the amount 
  1.25  levied. 
  2.1      Subd. 5.  [USES.] (a) Revenue received under this section 
  2.2   may only be used to: 
  2.3      (1) pay the costs incurred for the salaries, benefits, and 
  2.4   transportation of peace officers and sheriffs for liaison 
  2.5   services in the district's school building that qualifies for 
  2.6   the public safety revenue; 
  2.7      (2) pay the costs for a drug abuse prevention program as 
  2.8   defined in section 609.101, subdivision 3, paragraph (e); or 
  2.9      (3) pay the costs for a gang resistance education training 
  2.10  curriculum. 
  2.11     (b) The district must first contract for the services and 
  2.12  programs under paragraph (a) from the police department of the 
  2.13  city or the sheriff's department of the county within the 
  2.14  district where the school is located.  If the police department 
  2.15  or a county sheriff's department serving the city or county 
  2.16  where the school is located does not provide the necessary 
  2.17  services, the district may contract for these services with any 
  2.18  other police or sheriff's department located entirely or 
  2.19  partially within the district's boundaries.
