A bill for an act
relating to state government; specifying balances in
certain internal service funds; providing for transfer
of certain amounts to the general fund; amending
Minnesota Statutes 2004, section 16B.48, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 16B.48, is
amended by adding a subdivision to read:

new text begin For each fund or account
governed by this section, the commissioner must attempt to set
rates so that the cash balance in the fund or account will not
exceed two months' operating obligations for that fund or
account. If at the end of a fiscal year the cash balance in a
fund or account exceeds two months' operating obligations, the
commissioner must: (1) transfer the excess to the general fund,
except to the extent that federal law or the state constitution
provides otherwise; and (2) adjust the rates as necessary to
comply with the two-month standard of this subdivision.
