  1.1                          A bill for an act
  1.2             relating to residential building contractors; 
  1.3             requiring the commissioner of commerce to notify 
  1.4             current customers of licensees against whom 
  1.5             enforcement actions are taken; amending Minnesota 
  1.6             Statutes 2000, section 326.91, by adding a subdivision.
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 326.91, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 5.  [NOTICE.] (a) The provisions of this subdivision 
  1.11  apply whenever the commissioner suspends or revokes the license 
  1.12  of a licensee pursuant to the provisions of subdivision 1, 
  1.13  clause (1), (2), (3), (4), (6), (11), (13), or (14). 
  1.14     (b) If the commissioner suspends or revokes the license of 
  1.15  a licensee as provided in paragraph (a), the commissioner shall 
  1.16  obtain from the licensee a list of all persons for whom the 
  1.17  licensee is currently performing work under the license or has 
  1.18  agreed to perform such work in the future.  The commissioner 
  1.19  shall notify the licensee by personal service or certified mail 
  1.20  that the licensee is required to provide the list, and the 
  1.21  licensee shall provide the list by personal service or certified 
  1.22  mail.  The commissioner shall, within 60 days of the suspension 
  1.23  or revocation of the license, attempt to notify all persons who 
  1.24  are included on the list obtained under paragraph (a) that the 
  1.25  licensee's license has been revoked or suspended and the reason 
  1.26  for the suspension or revocation. 
  2.1      (c) Any licensee who fails to provide information requested 
  2.2   by the commissioner under paragraph (a) is guilty of a 
  2.3   misdemeanor.
