  1.1                          A bill for an act 
  1.2             relating to retirement; requiring the Minnesota state 
  1.3             retirement system and the department of employee 
  1.4             relations to submit a report on the number of 
  1.5             employees in the correctional plan to the legislative 
  1.6             commission on pensions and retirement; amending 
  1.7             Minnesota Statutes 1998, section 352.91, subdivision 4.
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 352.91, 
  1.10  subdivision 4, is amended to read: 
  1.11     Subd. 4.  [CERTIFICATION PROCEDURE FOR ADDITIONAL 
  1.12  POSITIONS.] (a) Upon the recommendation of the commissioner of 
  1.13  corrections or the commissioner of human services, whichever is 
  1.14  the appropriate employing authority, with the approval of the 
  1.15  legislative advisory committee and with notification to and 
  1.16  receipt of comments from the legislative commission on pensions 
  1.17  and retirement, the commissioner of employee relations may 
  1.18  certify additional positions at a state correctional facility, 
  1.19  the Minnesota security hospital, or the Minnesota sexual 
  1.20  psychopathic personality treatment center to the executive 
  1.21  director of the Minnesota state retirement system as positions 
  1.22  rendering covered correctional service.  The commissioner of 
  1.23  corrections and the commissioner of human services must 
  1.24  establish, in writing, a set of criteria upon which to base a 
  1.25  recommendation for certifying additional civil service 
  1.26  classifications as rendering covered correctional service. 
  2.1      (b) By January 1 of each year, the Minnesota state 
  2.2   retirement system and the department of employee relations must 
  2.3   submit a joint report to the legislative commission on pensions 
  2.4   and retirement.  The report must include, but is not limited to, 
  2.5   the number of employees included in the correctional plan by 
  2.6   appeal and a list of the employee classification titles included 
  2.7   in the correctional plan by appeal.
