  1.1                          A bill for an act 
  1.2             relating to education; encouraging nonlicensed 
  1.3             community experts to make progress toward obtaining 
  1.4             licensure; requiring school districts to notify 
  1.5             parents when students receive instruction from 
  1.6             nonlicensed community experts; amending Minnesota 
  1.7             Statutes 2000, section 122A.25, subdivision 2, and by 
  1.8             adding a subdivision.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 122A.25, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [APPLICATIONS; CRITERIA.] (a) The school district 
  1.13  or charter school shall apply to the board of teaching for 
  1.14  approval to hire nonlicensed teaching personnel from the 
  1.15  community.  In approving or disapproving the application for 
  1.16  each community expert, the board shall consider: 
  1.17     (1) the qualifications of the community person whom the 
  1.18  district or charter school proposes to employ; 
  1.19     (2) the reasons for the need for a variance from the 
  1.20  teacher licensure requirements; 
  1.21     (3) the district's efforts to obtain licensed teachers, who 
  1.22  are acceptable to the school board, for the particular course or 
  1.23  subject area or the charter school's efforts to obtain licensed 
  1.24  teachers for the particular course or subject area; 
  1.25     (4) the amount of teaching time for which the community 
  1.26  expert would be hired; 
  1.27     (5) the extent to which the district or charter school is 
  2.1   utilizing other nonlicensed community experts under this 
  2.2   section; 
  2.3      (6) the nature of the community expert's proposed teaching 
  2.4   responsibility; and 
  2.5      (7) the proposed level of compensation to the community 
  2.6   expert. 
  2.7      (b) The board of teaching must not approve an application 
  2.8   for hiring nonlicensed teaching personnel if the person has 
  2.9   previously taught under a nonlicensed community expert 
  2.10  credential and fails to provide evidence that the person is 
  2.11  making reasonable progress toward obtaining a teaching license.  
  2.12  A person may not teach under a nonlicensed community expert 
  2.13  credential for more than a cumulative total of three school 
  2.14  years. 
  2.15     [EFFECTIVE DATE.] This section is effective July 1, 2001. 
  2.16     Sec. 2.  Minnesota Statutes 2000, section 122A.25, is 
  2.17  amended by adding a subdivision to read: 
  2.18     Subd. 4.  [NOTICE OF NONLICENSED COMMUNITY EXPERT 
  2.19  REQUIRED.] A school district must notify in writing the parent 
  2.20  or guardian of a student who receives instruction from a 
  2.21  nonlicensed community expert. 
  2.22     [EFFECTIVE DATE.] This section is effective July 1, 2001.
