  1.1                          A bill for an act 
  1.2             relating to human services; establishing the Medicare 
  1.3             payment rate as the rate for all nursing facility 
  1.4             residents for the first 100 days following admission; 
  1.5             appropriating money; amending Minnesota Statutes 2000, 
  1.6             section 256B.431, by adding a subdivision; repealing 
  1.7             Minnesota Statutes 2000, section 256B.434, subdivision 
  1.8             5. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 256B.431, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 31.  [PAYMENT DURING FIRST 100 DAYS.] (a) For rate 
  1.13  years beginning on or after July 1, 2001, the total payment rate 
  1.14  for a facility reimbursed under this section, section 256B.434, 
  1.15  or any other section the first 100 days after admission shall be 
  1.16  the facility's Medicare payment rate. 
  1.17     (b) Beginning with day 101 of continuous residence, the 
  1.18  payment rate shall be the rate otherwise determined under this 
  1.19  section, section 256B.434, or any other section. 
  1.20     (c) This subdivision applies to admissions occurring on or 
  1.21  after July 1, 2001. 
  1.22     Sec. 2.  [APPROPRIATION.] 
  1.23     $....... is appropriated from the general fund to the 
  1.24  commissioner of human services for the biennium beginning July 
  1.25  1, 2001, for the purposes of section 1. 
  1.26     Sec. 3.  [REPEALER.] 
  1.27     Minnesota Statutes, section 256B.434, subdivision 5, is 
  2.1   repealed.
