A bill for an act
relating to health; establishing a working group to make recommendations on
methods to reduce administrative burdens for nursing homes in the state.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin RECOMMENDATIONS TO REDUCE ADMINISTRATIVE
BURDENS; NURSING HOMES.

new text begin Subdivision 1. new text end

new text begin Establishment; members. new text end

new text begin The commissioner of health must
convene a working group to study and make recommendations to the legislature as to
possible methods for reducing administrative burdens for nursing homes in the state. The
working group must consist of no more than ten members including, but not limited to,
the following:

new text begin (1) at least one member appointed by the commissioner of health;
new text end

new text begin (2) at least one member appointed by the commissioner of human services;
new text end

new text begin (3) at least three members representing nursing homes, including at least one nursing
home administrator;
new text end

new text begin (4) at least one member appointed by the Board on Aging; and
new text end

new text begin (5) at least one member appointed by the ombudsman for long-term care.

new text begin The appointing authorities under this subdivision must complete their appointments
by June 1, 2012.

new text begin The working group established under this
section must study the current state and federal reporting and inspection requirements for
nursing homes in this state and make recommendations for how these reports can be
consolidated or eliminated to reduce administrative burdens on nursing homes in the
state without jeopardizing patient safety.

new text begin The commissioner of health must convene the first meeting by
June 1, 2012. Meetings must be open to the public. The members of the working group
shall select a chair from their membership at the first meeting.

new text begin Report. new text end

new text begin By December 15, 2012, the commissioner of health, with the
commissioner of human services, must submit to the legislature a report providing the
findings and recommendations of the working group. The report must include drafts
of any statutory or rule changes that are needed to implement the working group's
recommendations.

subdivision 4 is submitted.
