A bill for an act
relating to education; modifying open enrollment priorities; amending Minnesota
Statutes 2016, section 124D.03, subdivision 5a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 124D.03, subdivision 5a, is amended to read:


Subd. 5a.

Lotteries.

a specific grade level, it must hold an impartial lottery following the January 15 deadline
to determine which students will receive seats.new text begin The district must give priority to enrolling:

within the boundaries of that school district if that nonpublic school has an articulation
agreement with the school district according to paragraph (c).

new text begin (b)new text end The process for the school district lottery must be established in school district policy,
approved by the school board, and posted on the school district's Web site.

new text begin (c) A school board and the governing body of a nonpublic school located within the
boundaries of that school district may jointly adopt a written articulation agreement. The
agreement may authorize priority enrollment for students attending the nonpublic school.

new text begin This section is effective July 1, 2017, for lotteries conducted on
or after that date.
