1.1 A bill for an act 1.2 relating to education finance; creating ongoing 1.3 funding for career and technical education programs; 1.4 appropriating money; amending Minnesota Statutes 2000, 1.5 section 124D.453, subdivisions 1, 2, 3, 4, by adding 1.6 subdivisions; repealing Minnesota Statutes 2000, 1.7 section 124D.453, subdivision 5; Laws 1999, chapter 1.8 241, article 3, section 5, as amended. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Minnesota Statutes 2000, section 124D.453, 1.11 subdivision 1, is amended to read: 1.12 Subdivision 1. [STATE PAYMENT OF AIDS.] The state shall 1.13 pay aids for approved career and technical programson a current1.14funding basisaccording to this section. 1.15 Sec. 2. Minnesota Statutes 2000, section 124D.453, 1.16 subdivision 2, is amended to read: 1.17 Subd. 2. [LIMIT.] The commissioner maywithhold all or any1.18portion ofreduce the aid paid under this section for a career 1.19 and technical education programwhich receives funds from any1.20other source. A district or center must not receive aso that 1.21 the total amount of state aidpursuant toreceived under this 1.22 section which, when added to funds from other sources,will1.23provide the program an amount for salaries and travel which1.24exceedsdoes not exceed 100 percent of theamount of its1.25expenditures for salaries and travel in theprogram costs. 1.26 Sec. 3. Minnesota Statutes 2000, section 124D.453, is 1.27 amended by adding a subdivision to read: 2.1 Subd. 2a. [PROGRAM APPROVAL.] (a) All currently approved 2.2 career and technical programs must be reapproved under the terms 2.3 of this subdivision by June 30, 2003. 2.4 (b) In order to receive career and technical education aid 2.5 under this section, a school district must have a career and 2.6 technical plan approved by the commissioner of children, 2.7 families, and learning. A district's plan must: 2.8 (1) demonstrate that access to meet state graduation 2.9 standards exists in the career and technical education content 2.10 areas that are being implemented; 2.11 (2) document that the career and technical education 2.12 program is imparting skills to students that meet 2.13 industry-recognized standards; 2.14 (3) show that career and technical education programming 2.15 provided at the secondary level is articulated with 2.16 post-secondary instruction in those areas; and 2.17 (4) contain a continuous improvement plan. 2.18 Sec. 4. Minnesota Statutes 2000, section 124D.453, 2.19 subdivision 3, is amended to read: 2.20 Subd. 3. [CAREER AND TECHNICAL AID.] A district's career 2.21 and technical education aid for fiscal years2000 and 20012002 2.22 and later equalsthe lesser of: 2.23 (a)$73 times the district's average daily membership in2.24grades 10 to 12; orfor a district that provides students access 2.25 to one or two career and technical education content areas, the 2.26 greater of $10,000 or .01 times the formula allowance for that 2.27 year times the district's adjusted average daily membership in 2.28 grades 10 to 12; or 2.29 (b)25 percent of approved expenditures for the following:2.30(1) salaries paid to essential, licensed personnel2.31providing direct instructional services to students in that2.32fiscal year for services rendered in the district's approved2.33career and technical education programs;2.34(2) contracted services provided by a public or private2.35agency other than a Minnesota school district or cooperative2.36center under subdivision 7;3.1(3) necessary travel between instructional sites by3.2licensed career and technical education personnel;3.3(4) necessary travel by licensed career and technical3.4education personnel for vocational student organization3.5activities held within the state for instructional purposes;3.6(5) curriculum development activities that are part of a3.7five-year plan for improvement based on program assessment;3.8(6) necessary travel by licensed career and technical3.9education personnel for noncollegiate credit bearing3.10professional development; and3.11(7) specialized vocational instructional supplies.3.12(c) Up to ten percent of a district's career and technical3.13aid may be spent on equipment purchases. Districts using career3.14and technical aid for equipment purchases must report to the3.15department on the improved learning opportunities for students3.16that result from the investment in equipmentfor a district that 3.17 provides students access to three or more career and technical 3.18 content areas, the greater of $20,000 or .02 times the formula 3.19 allowance for that year times the district's adjusted average 3.20 daily membership in grades 10 to 12. 3.21 Sec. 5. Minnesota Statutes 2000, section 124D.453, is 3.22 amended by adding a subdivision to read: 3.23 Subd. 3a. [REVENUE USES.] Career and technical education 3.24 aid may be used for: 3.25 (1) salaries paid to essential, licensed personnel 3.26 providing direct instructional services to students in that 3.27 fiscal year for services rendered in the district's approved 3.28 career and technical education programs; 3.29 (2) contracted services provided by a public or private 3.30 agency other than a Minnesota school district or cooperative 3.31 center under subdivision 7; 3.32 (3) necessary travel between instructional sites by 3.33 licensed career and technical education personnel; 3.34 (4) necessary travel by licensed career and technical 3.35 education personnel for vocational student organization 3.36 activities held within the state for instructional purposes; 4.1 (5) curriculum development activities that are part of a 4.2 five-year plan for improvement based on program assessment; 4.3 (6) necessary travel by licensed career and technical 4.4 education personnel for noncollegiate credit-bearing 4.5 professional development; 4.6 (7) specialized vocational instructional supplies; 4.7 (8) salaries paid for leadership and coordination services; 4.8 (9) teacher internships; and 4.9 (10) equipment purchases. 4.10 Sec. 6. Minnesota Statutes 2000, section 124D.453, 4.11 subdivision 4, is amended to read: 4.12 Subd. 4. [ALLOCATION FROMCOOPERATIVECENTERS AND4.13INTERMEDIATE DISTRICTSPROGRAMMING.]For purposes of4.14subdivisions 3, paragraph (b), and 5, paragraph (b), a4.15cooperative center or an intermediate district must allocate its4.16approved expenditures for career and technical education4.17programs among participating districts. For purposes of4.18subdivision 5, paragraph (a), a cooperative center or an4.19intermediate district must allocate its secondary vocational aid4.20for fiscal year 1994 among participating districts. For 19954.21and later fiscal years, career and technical aid for services4.22provided by a cooperative center or an intermediate district4.23shall be paid to the participating district.A district may 4.24 include in its approved program access to career and technical 4.25 education content areas offered on a cooperative basis. 4.26 Agreements to offer access to career and technical education 4.27 content areas through cooperation may include programs offered 4.28 by joint powers agreements, intermediate school districts, 4.29 education districts, vocational centers, or similar agreements 4.30 approved by all participating school boards. 4.31 Sec. 7. [APPROPRIATIONS.] 4.32 The sums designated are appropriated in the fiscal years 4.33 indicated from the general fund to the commissioner of children, 4.34 families, and learning for the payment of career and technical 4.35 education aid: 4.36 $.,...,... ..... 2002 5.1 $.,...,... ..... 2003 5.2 Sec. 8. [REPEALER.] 5.3 Minnesota Statutes 2000, section 124D.453, subdivision 5; 5.4 and Laws 1999, chapter 241, article 3, section 5, as amended by 5.5 Laws 2000, chapter 489, article 4, section 9, are repealed. 5.6 [EFFECTIVE DATE.] This section is effective the day 5.7 following final enactment.
