  1.1                          A bill for an act
  1.2             relating to metropolitan government; establishing the 
  1.3             legislative commission on the metropolitan airports 
  1.4             commission; providing for oversight of the 
  1.5             metropolitan airports commission's operating and 
  1.6             capital budgets, work program, and capital improvement 
  1.7             program; requiring legislative authorization for the 
  1.8             metropolitan airports commission to adopt its budget, 
  1.9             work program, and capital improvement program; 
  1.10            proposing coding for new law in Minnesota Statutes, 
  1.11            chapters 3; 473. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  [3.99] [LEGISLATIVE COMMISSION ON THE 
  1.14  METROPOLITAN AIRPORTS COMMISSION.] 
  1.15     Subdivision 1.  [ESTABLISHED.] The legislative commission 
  1.16  on the metropolitan airports commission (MAC) is established to 
  1.17  oversee the MAC's operating and capital budgets, work program, 
  1.18  and capital improvement program. 
  1.19     Subd. 2.  [MEMBERSHIP.] The legislative commission on the 
  1.20  MAC consists of four senators appointed by the senate 
  1.21  subcommittee on committees of the committee on rules and 
  1.22  administration, three senators appointed by the senate minority 
  1.23  leader, four state representatives appointed by the speaker of 
  1.24  the house, and three state representatives appointed by the 
  1.25  house minority leader.  All appointed members must reside in the 
  1.26  seven-county metropolitan area.  Each appointing authority shall 
  1.27  make appointments as soon as possible after the beginning of the 
  1.28  regular session of a new legislature in each odd-numbered year 
  2.1   and should include appointments of legislators whose legislative 
  2.2   districts are most affected by the activities of a public 
  2.3   airport in the metropolitan area.  The chairs of the house and 
  2.4   senate policy committees on the environment, economic 
  2.5   development, and transportation are ex-officio nonvoting members 
  2.6   of the legislative commission. 
  2.7      Subd. 3.  [TERMS; VACANCIES.] Members of the legislative 
  2.8   commission on the MAC serve for a two-year term beginning upon 
  2.9   appointment and expiring upon appointment of a successor after 
  2.10  the beginning of the regular session of the next legislature in 
  2.11  the odd-numbered year.  A vacancy in the membership of the 
  2.12  legislative commission must be filled for the unexpired term in 
  2.13  a manner that will preserve the representation established by 
  2.14  this section. 
  2.15     Subd. 4.  [CHAIR.] The legislative commission on the MAC 
  2.16  shall meet as soon as practicable after members are appointed in 
  2.17  each odd-numbered year to elect its chair and other officers as 
  2.18  it may determine necessary.  A chair shall serve a two-year 
  2.19  term, expiring in the odd-numbered year after a successor is 
  2.20  elected.  The chair shall alternate biennially between the 
  2.21  senate and the house. 
  2.22     Subd. 5.  [COMPENSATION.] Members serve without 
  2.23  compensation but may be reimbursed for their reasonable expenses 
  2.24  as members of the legislature. 
  2.25     Subd. 6.  [STAFF.] Legislative staff shall provide 
  2.26  administrative and research assistance to the legislative 
  2.27  commission on the MAC. 
  2.28     Subd. 7.  [MEETINGS; PROCEDURES.] The legislative 
  2.29  commission on the MAC shall meet at the call of the chair.  If 
  2.30  there is a quorum, the legislative commission may take action by 
  2.31  a simple majority vote of the appointed legislative commission 
  2.32  members present. 
  2.33     Subd. 8.  [POWERS; DUTIES; MAC BUDGET OVERSIGHT.] The 
  2.34  legislative commission on the MAC shall monitor the operating 
  2.35  and capital budgets, work program, and capital improvement 
  2.36  program of the MAC to make recommendations to the MAC and the 
  3.1   legislature on the work and role of the MAC in (1) fulfilling 
  3.2   its purposes under section 473.602, (2) building the region's 
  3.3   international competitiveness, and (3) ensuring that its 
  3.4   facilities meet or exceed international standards.  The 
  3.5   legislative commission on the MAC shall also review the proposed 
  3.6   operating and capital budgets, work program, and capital 
  3.7   improvement program of the MAC for the next calendar biennium 
  3.8   and make recommendations to the legislature on whether to 
  3.9   authorize the MAC to implement the proposed budgets and work 
  3.10  program. 
  3.11     Subd. 9.  [POWERS; DUTIES; MAC APPOINTMENTS OVERSIGHT.] The 
  3.12  legislative commission on the MAC shall monitor appointments to 
  3.13  the MAC and may make recommendations on appointments to the 
  3.14  governor before the governor makes the appointments.  The 
  3.15  legislative commission may also make recommendations to the 
  3.16  senate before appointments are presented to the senate for its 
  3.17  advice and consent. 
  3.18     Sec. 2.  [473.246] [LEGISLATIVE COMMISSION ON MAC; 
  3.19  LEGISLATIVE APPROVAL REQUIRED.] 
  3.20     The metropolitan airports commission (MAC) shall prepare 
  3.21  proposed operating and capital budgets, work program, and 
  3.22  capital improvement program for review by the legislative 
  3.23  commission on the metropolitan airports commission (MAC), as 
  3.24  provided in section 3.99.  The MAC shall submit to the 
  3.25  legislative commission on the MAC by January 15 of each 
  3.26  odd-numbered year the MAC's proposed operating and capital 
  3.27  budgets, work program, capital improvement program, and any 
  3.28  other information requested by the legislative commission on the 
  3.29  MAC, for the two calendar years beginning January 1 of the next 
  3.30  odd-numbered year.  The MAC must not adopt its budgets, work 
  3.31  program, or capital improvement program unless authorized by law.
  3.32     Sec. 3.  [APPLICATION.] 
  3.33     Section 2 applies in the counties of Anoka, Carver, Dakota, 
  3.34  Hennepin, Ramsey, Scott, and Washington.
