  1.1                          A bill for an act 
  1.2             relating to highways; advancing construction projects 
  1.3             on I-494; suspending construction of I-35W/trunk 
  1.4             highway No. 62 improvement project until I-494 work is 
  1.5             completed; redirecting available funds from 
  1.6             I-35W/trunk highway No. 62 project to I-494 project; 
  1.7             imposing moratorium on issuance of certain permits and 
  1.8             adoption of certain ordinances. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [ADVANCEMENT OF I-494 TRANSPORTATION PROJECTS 
  1.11  IN CONSTRUCTION SCHEDULE.] 
  1.12     The commissioner of transportation shall advance the 
  1.13  construction schedule of the following projects to the maximum 
  1.14  feasible extent: 
  1.15     (1) construction of third through lane in each direction 
  1.16  and replacement and redecking of bridges on I-494 from trunk 
  1.17  highway No. 5 to trunk highway No. 100; and 
  1.18     (2) construction of third lane in each direction and 
  1.19  replacement of bridges on I-494 between I-394 and trunk highway 
  1.20  No. 5. 
  1.21     Sec. 2.  [TEMPORARY SUSPENSION OF I-35W/TRUNK HIGHWAY NO. 
  1.22  62 TRANSPORTATION CONSTRUCTION PROJECT.] 
  1.23     The commissioner of transportation shall temporarily 
  1.24  suspend work on the I-35W/trunk highway No. 62 improvement 
  1.25  project, involving separation of the two roadways in the commons 
  1.26  area, replacement of ramps, construction of a high-occupancy 
  1.27  vehicle lane, and changes in access.  The commissioner shall 
  2.1   resume work on this project after the completion of the 
  2.2   transportation construction projects described in section 1. 
  2.3      Sec. 3.  [REDIRECTION OF FUNDS.] 
  2.4      The commissioner of transportation shall redirect all funds 
  2.5   available from any source for the I-35W/trunk highway No. 62 
  2.6   improvement project to the I-494 reconstruction projects 
  2.7   described in section 1 until the described I-494 construction 
  2.8   projects are completed. 
  2.9      Sec. 4.  [MORATORIUM ON ISSUANCE OF CERTAIN PERMITS AND 
  2.10  ADOPTION OF CERTAIN ORDINANCES.] 
  2.11     A moratorium exists on issuance of any building permit or 
  2.12  conditional use permit; establishment of any utility connection 
  2.13  or utility permit; or adoption of any variances or zoning change 
  2.14  that affects a project that: 
  2.15     (1) is located within Hennepin county; 
  2.16     (2) involves the creation or addition of more than 2,000 
  2.17  parking spaces; 
  2.18     (3) is located within 500 yards of a portion of an 
  2.19  interstate or trunk highway that is identified by the 
  2.20  metropolitan council or commissioner of transportation as a 
  2.21  corridor that experiences congestion an average of two hours or 
  2.22  more each weekday in seven consecutive days; and 
  2.23     (4) is located within 500 yards of an interstate or trunk 
  2.24  highway as to which the commissioner of transportation plans to 
  2.25  let contracts, within five years from the date of the building 
  2.26  permit application, for a reconstruction project to add capacity 
  2.27  to the highway. 
  2.28     The moratorium shall end as to an affected building permit 
  2.29  when the highway construction project described in clause (4) is 
  2.30  completed. 
  2.31     Sec. 5.  [APPLICATION.] 
  2.32     This act applies to Hennepin county. 
  2.33     Sec. 6.  [EFFECTIVE DATE.] 
  2.34     Sections 1 to 5 are effective the day following final 
  2.35  enactment.
