A bill for an act
relating to crimes; creating a committee to study and
recommend adjusting dollar threshold amounts in
property crimes.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin CRIMINAL PROPERTY OFFENSE MONETARY THRESHOLD
COMMITTEE.

new text begin Establishment; duties. new text end

new text begin A criminal
property offense monetary threshold committee is established to
study and propose adjusting threshold dollar amounts of property
crimes. The committee shall identify the property crimes in
addition to theft, as defined in Minnesota Statutes, section
609.52, that contain threshold dollar amounts that require
revision. In determining how much property crime threshold
dollar amounts should be revised, the committee shall take into
consideration the Consumer Price Index for urban, suburban, and
rural consumers in Minnesota, and any other historical and
economic factors relevant to a rational and proportianate
adjustment of thresholds.

new text begin The committee may use legislative
staff to provide legal counsel, research, and secretarial and
clerical assistance. The Sentencing Guidelines Commission,
Department of Corrections, and state court administrator shall
provide technical assistance to the committee on request.

new text begin The committee consists of:

new text begin (1) three senators, no more than two of whom are from the
same political party, appointed by the senate Subcommittee on
Committees of the Committee on Rules and Administration and
three members of the house of representatives, no more than two
of whom are from the same political party, appointed by the
speaker;

new text begin (2) representatives from each of the following groups
appointed by the chairs of the senate Committee on Crime
Prevention and Public Safety and the house Public Safety and
Finance Committee:

new text begin (i) crime victim advocates;
new text end

new text begin (ii) county attorneys;
new text end

new text begin (iii) city attorneys;
new text end

new text begin (iv) professors of law with expertise in criminal justice;

new text begin (v) district court judges;
new text end

new text begin (vi) criminal defense attorneys;

new text begin (vii) probation officers; and
new text end

new text begin (viii) public members who are victims of crime; and

new text begin (3) the state court administrator who shall chair the group.

new text begin The committee shall present
the legislature with dollar threshold adjustment recommendations
in the form of a bill that amends the property crime statutes it
has identified as in need of revision no later than January 15,
2006. The bill shall be presented to the chair of the senate
Crime Prevention and Public Safety Committee and house Public
Safety and Finance Committee.
