A bill for an act
relating to health; modifying MinnesotaCare
eligibility requirements for persons with continuation
coverage; amending Minnesota Statutes 2004, section
256L.07, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 256L.07, is
amended by adding a subdivision to read:

new text begin Exemption for persons with continuation
coverage.

new text begin (a) Families, children, and individuals who want to
apply for the MinnesotaCare program upon termination from
continuation coverage required under federal or state law are
exempt from the requirements of subdivision 3.

new text begin (b) For purposes of paragraph (a), "termination from
continuation coverage" means involuntary termination for any
reason, other than nonpayment of premium by the family, child,
or individual. Involuntary termination includes termination of
coverage due to reaching the end of the maximum period for
continuation coverage required under federal or state law.
