  1.1                          A bill for an act 
  1.2             relating to natural resources; establishing a stream 
  1.3             protection and improvement loan program; appropriating 
  1.4             money; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 103G. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [103G.705] [STREAM PROTECTION AND IMPROVEMENT 
  1.8   LOAN PROGRAM.] 
  1.9      (a) A political subdivision may apply to the commissioner 
  1.10  for a loan for up to 90 percent of the local share of the 
  1.11  project costs to protect or improve a stream.  By January 15 of 
  1.12  each year, the commissioner must provide the legislature with a 
  1.13  list of all applications received by the commissioner, the loan 
  1.14  amounts requested by the applicants, and a ranking of the 
  1.15  applications receiving a favorable recommendation.  
  1.16     (b) After receiving a favorable recommendation from the 
  1.17  commissioner and the approval of the legislature, a political 
  1.18  subdivision may apply to the commissioner of finance for a loan 
  1.19  on forms supplied by the commissioner of finance.  The 
  1.20  commissioner of finance must make the loan to the political 
  1.21  subdivision in the amount and under the terms specified.  Loans 
  1.22  made under this section do not require the approval of the 
  1.23  electors of the political subdivision as provided in section 
  1.24  475.58.  
  1.25     (c) A loan made under this section must be repaid without 
  2.1   interest over a period not to exceed ten years.  The 
  2.2   commissioner of finance may charge an annual administrative fee 
  2.3   to the political subdivision. 
  2.4      (d) A political subdivision receiving a loan made under 
  2.5   this section must levy for the loan repayment beginning in the 
  2.6   year the loan proceeds are received and succeeding years until 
  2.7   the loan and the associated administrative costs are repaid.  
  2.8   The levy must be for: 
  2.9      (1) the amount of the annual loan repayment and the 
  2.10  associated administrative costs; or 
  2.11     (2) the amount of the annual loan repayment and 
  2.12  administrative costs less the amount the political subdivision 
  2.13  certifies it has received from other sources for the loan 
  2.14  repayment. 
  2.15     (e) The commissioner of finance must transfer the principal 
  2.16  amounts of loan repayments received under this section to the 
  2.17  state bond fund. 
  2.18     Sec. 2.  [BROWN'S CREEK PROTECTION PROJECT; APPROPRIATION.] 
  2.19     $3,500,000 is appropriated in fiscal year 2000 from the 
  2.20  general fund to the commissioner of finance for a loan to the 
  2.21  city of Stillwater for the protection of Brown's creek pursuant 
  2.22  to the terms and conditions and for the purposes specified in 
  2.23  section 1.
