  1.1                          A bill for an act 
  1.2             relating to human services; removing an ineligibility 
  1.3             provision for general assistance and general 
  1.4             assistance medical care; amending Laws 1997, chapter 
  1.5             203, article 9, section 21, as amended. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1997, chapter 203, article 9, section 21, 
  1.8   as amended by Laws 1998, chapter 407, article 6, section 111, 
  1.9   and Laws 2000, chapter 488, article 10, section 28, is amended 
  1.10  to read: 
  1.11     Sec. 21.  [INELIGIBILITY FOR STATE FUNDED PROGRAMS.] 
  1.12     (a) Effective on the date specified, the following persons 
  1.13  will be ineligible for general assistance and general assistance 
  1.14  medical care under Minnesota Statutes, chapter 256D, group 
  1.15  residential housing under Minnesota Statutes, chapter 256I, and 
  1.16  MFIP assistance under Minnesota Statutes, chapter 256J, funded 
  1.17  with state money: 
  1.18     (1) Beginning July 1, 2002, persons who are terminated from 
  1.19  or denied Supplemental Security Income due to the 1996 changes 
  1.20  in the federal law making persons whose alcohol or drug 
  1.21  addiction is a material factor contributing to the person's 
  1.22  disability ineligible for Supplemental Security Income, and are 
  1.23  eligible for general assistance under Minnesota Statutes, 
  1.24  section 256D.05, subdivision 1, paragraph (a), clause 15, 
  1.25  general assistance medical care under Minnesota Statutes, 
  2.1   chapter 256D, or group residential housing under Minnesota 
  2.2   Statutes, chapter 256I; 
  2.3      (2) Beginning July 1, 2002, legal noncitizens who are 
  2.4   ineligible for Supplemental Security Income due to the 1996 
  2.5   changes in federal law making certain noncitizens ineligible for 
  2.6   these programs due to their noncitizen status; and 
  2.7      (3) (2) Beginning July 1, 2001, legal noncitizens who are 
  2.8   eligible for MFIP assistance, either the cash assistance portion 
  2.9   or the food assistance portion, funded entirely with state money.
  2.10     (b) State money that remains unspent due to changes in 
  2.11  federal law enacted after May 12, 1997, that reduce state 
  2.12  spending for legal noncitizens or for persons whose alcohol or 
  2.13  drug addiction is a material factor contributing to the person's 
  2.14  disability, or enacted after February 1, 1998, that reduce state 
  2.15  spending for food benefits for legal noncitizens shall not 
  2.16  cancel and shall be deposited in the TANF reserve account.
