A bill for an act
relating to employment; appropriating money for enforcement of prevailing
wages.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PREVAILING WAGE ENFORCEMENT; APPROPRIATION.

new text begin $300,000 is appropriated each year beginning in fiscal year 2010 from the general
fund to the commissioner of labor and industry for prevailing wage enforcement under
Minnesota Statutes, sections 177.41 to 177.44. The commissioner must not reduce
funding available for prevailing wage enforcement and must fill all positions when
vacancies become available. Any open positions must first be offered to individuals
previously employed by the department to receive, investigate, or process the registration
of independent contractors in the construction industry. The persons hired under this
provision may be assigned only to investigate reports of prevailing wage violations or to
train other persons for the purposes of prevailing wage enforcement. This appropriation
shall not be used to teach contractors how to file documentation used to establish wage
rates.
