A bill for an act
relating to public safety; creating a misdemeanor penalty for harassment or
retaliation against a person subject to an order for protection or no contact order;
amending Minnesota Statutes 2010, sections 518B.01, by adding a subdivision;
629.75, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2010, section 518B.01, is amended by adding a
subdivision to read:

When an order for
protection grants relief authorized in subdivision 6, paragraph (a), clause (2) or (3), it is
a misdemeanor for the petitioner, with the intent of harassing or retaliating against the
abusing party, to invite the abusing party to the petitioner's dwelling or residence or the
surrounding area from which the abusing party is excluded, knowing that admittance is
a violation of the order.

This section is effective August 1, 2012, and applies to crimes
committed on or after that date.

Minnesota Statutes 2010, section 629.75, is amended by adding a subdivision
to read:

When a domestic abuse
order is issued against a defendant, it is a misdemeanor for the alleged victim protected
under the order, with the intent of harassing or retaliating against the abusing party,
to invite the defendant to the alleged victim's dwelling or residence knowing that such
contact is a violation of the order.
