relating to state government; providing for revenue-producing programs in the
event of a government shutdown; proposing coding for new law in Minnesota
Statutes, chapter 16A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

GOVERNMENT PROGRAMS DURING A GOVERNMENT SHUTDOWN.

new text begin Government shutdown. new text end

new text begin A government shutdown is a period on
and after July 1 of an odd-numbered year, in which one or more of the bills making
appropriations for the following areas have not been enacted: higher education, education,
agriculture, environment and natural resources, health and human services, state
government, jobs and economic development, transportation, judiciary, public safety, and
aids and credits to local government. This section does not require appropriations bills to
be organized in the manner specified in this section.

new text begin Continuation of revenue-producing programs. new text end

new text begin During a government
shutdown as described in subdivision 1, a state agency shall continue any program that
generates revenue. Those revenue-producing programs must be kept operational and fully
funded to maintain the program operation.

new text begin The funding necessary to continue the operation of a
revenue-producing program is appropriated from the fund in the state treasury that is
used to carry on the operation of the state revenue-producing program in the amount
last enacted and signed into law.
