relating to health; creating an Autism Spectrum Disorder Joint Legislative Task
Force; providing appointments; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin AUTISM SPECTRUM DISORDER JOINT LEGISLATIVE TASK
FORCE.

new text begin (a) The Autism Spectrum Disorder Joint Legislative Task Force is created in the
legislative branch of state government.

new text begin (b) The joint task force shall be composed of 25 members:
new text end

new text begin (1) two members of the senate, one from the majority party and one from the
minority party, appointed by the senate Subcommittee on Committees of the Committee
on Rules and Administration;

new text begin (2) two members of the house of representatives, one from the majority party and
one from the minority party, appointed by the speaker of the house; and
new text end

new text begin (3) the remaining members shall be appointed by the Subcommittee on Committees
of the Committee on Rules and Administration and the speaker of the house, and shall
include:

new text begin (i) three members who are parents of children with autism spectrum disorder;
new text end

new text begin (ii) two members who have autism spectrum disorder;
new text end

new text begin (iii) one member representing an agency that provides residential housing services to
individuals with autism spectrum disorder;
new text end

new text begin (iv) one member representing an agency that provides employment services to
individuals with autism spectrum disorder;
new text end

new text begin (v) one member who is a behavior analyst;
new text end

new text begin (vi) one member who is a neurological psychologist or psychiatrist;
new text end

new text begin (vii) one member who is a developmental behavioral pediatrician;
new text end

new text begin (viii) one member who is a pediatrician or family practice physician;
new text end

new text begin (ix) one member representing the Association of Minnesota Counties;
new text end

new text begin (x) one member representing the Minnesota Association of School Administrators;
new text end

new text begin (xi) one member representing autism spectrum disorder school classroom specialists;
new text end

new text begin (xii) one member representing the directors of public school student support services;
new text end

new text begin (xiii) one member who is a provider of autism spectrum disorder therapy;
new text end

new text begin (xiv) one member representing the Somali American Autism Foundation;
new text end

new text begin (xv) one member representing ARC of Minnesota;
new text end

new text begin (xvi) one member representing the Autism Society of Minnesota;
new text end

new text begin (xvii) one member representing the Parent Advocacy Coalition for Educational
Rights (PACER); and
new text end

new text begin (xviii) one member representing the Minnesota Council of Health Plans.

new text begin Appointments must be made by September 1, 2009, and must be reported to the
Legislative Coordinating Commission.

new text begin (c) The Departments of Education, Employment and Economic Development,
Health, and Human Services shall provide substantive assistance to the task force,
including providing the task force with a count of children who have autism spectrum
disorder (ASD) with an individual education program (IEP) or an individual family
service plan (IFSP) and children with ASD who have a 504 plan. The departments shall
provide any other information that is deemed necessary by the task force that is within the
purview of the departments. Additionally, the Department of Human Services shall submit
a count of the adults with ASD enrolled in social service programs and the number of
individuals with ASD who are enrolled in medical assistance and other waiver programs.

new text begin (d) The task force shall elect a chair or cochairs at its first meeting.

new text begin (e) The task force shall examine the following:

new text begin (1) ways to improve services provided by all state and political subdivisions;
new text end

new text begin (2) sources of public funding available for treatment and ways to improve efficiency
in the use of these funds;
new text end

new text begin (3) methods to improve coordination in the delivery of service between public and
private agencies, health providers, and schools;
new text end

new text begin (4) increasing the availability of and the training for medical providers who provide
services to individuals with ASD;
new text end

new text begin (5) increasing the availability of and the training for educators who identify and
educate individuals with ASD;
new text end

new text begin (6) scientific research on the most effective treatment methods;
new text end

new text begin (7) ways to enhance Minnesota's role in ASD research and delivery of service; and
new text end

new text begin (8) methods to educate parents, family members, and the public on ASD and the
required services.

new text begin (f) The task force shall provide an annual written report to the legislature in
compliance with Minnesota Statutes, sections 3.195 and 3.197.
