  1.1                          A bill for an act 
  1.2             relating to insurance; regulating the reporting of 
  1.3             insurance information; prohibiting credit scoring; 
  1.4             amending Minnesota Statutes 2000, sections 72A.20, by 
  1.5             adding a subdivision; and 72A.491, subdivision 5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 72A.20, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 36.  [PROHIBITION ON USE OF CREDIT INFORMATION FOR 
  1.10  UNDERWRITING PURPOSES IN HOMEOWNERS AND AUTO INSURANCE.] An 
  1.11  insurer, insurance agent, or insurance-support organization may 
  1.12  not obtain, cause to be prepared, or furnish a consumer report 
  1.13  that the insurer, agent, or support organization has reason to 
  1.14  believe will be used in connection with the underwriting of 
  1.15  homeowners insurance, as defined by section 65A.27, or motor 
  1.16  vehicle insurance, as defined by section 65B.01, involving the 
  1.17  consumer. 
  1.18     Sec. 2.  Minnesota Statutes 2000, section 72A.491, 
  1.19  subdivision 5, is amended to read: 
  1.20     Subd. 5.  [CONSUMER REPORT.] "Consumer report" means any 
  1.21  written, oral, or other communication, including credit 
  1.22  reporting products known as "credit scores," of information 
  1.23  bearing on a person's credit worthiness, credit standing, credit 
  1.24  capacity, character, general reputation, personal 
  1.25  characteristics, or mode of living that is used or expected to 
  2.1   be used in connection with an insurance transaction.
